What’s the difference between an uncontested divorce and a contested divorce? Uncontested means that the parties have an agreement basically asked to all of the issues in the case which might include a parenting plan for children, Child Support, take care, division of all assets and liabilities.
  in a contested divorce, the case is filed, and the other party receives the initial papers by service process, which is the sheriffs department, or a private process server. In the petition for dissolution of marriage, the person filing the initial petition will lay out some of the details, factual, things, like the date of the marriage, the date of separation, children, assets, requests for health insurance, request for child, support and alimony, etc. The other party will file an answer  and very often and files their own counter petition. The parties them prepare financial affidavits and exchange all financial data. Any such case is required to go to mediation to attempt to settle prior to any judge hearing the case.
 An uncontested divorce can be done for a flat fee plus court filing fees.
 If the divorce is contested, you again have filing fees, for the attorneys will charge an hourly rate for the time spent on the case.
