On July 1, 2025, important new privacy protections for reproductive and sexual health data took effect in Virginia. This amendment to the Virginia Consumer Protection Act (VCPA) makes the Commonwealth one of the first states to provide heightened safeguards for this sensitive category of information.

The reproductive or sexual health information protection prohibit companies from “obtaining, disclosing, selling, or disseminating any personally identifiable reproductive or sexual health information without the consent of the consumer.”

The law also establishes a private right of action, giving consumers the ability to enforce their rights directly in court. This raises the stakes for compliance, exposing business to potential litigation as well as regulatory scrutiny from the Attorney General of Virginia. Violations of the VCPA carry statutory damages of $500 for general violations and $1,000 for willful violations. This private right of action is a key distinction from the protections afforded under Virginia’s Consumer Data Protection Act (VCDPA).

Over the last few years, there has been a growing interest by states in children’s privacy. The Children’s Online Privacy Protection Act (COPPA) gives the Federal Trade Commission the ability to enforce privacy violations involving children. However, many states have not enacted similar state legislation to protect the privacy of children residing in their states.

Last year, Governor Glenn Youngkin signed Senate Bill 361/House Bill 707, which amended the Virginia Consumer Data Protection Act to include new requirements for how controllers process the data of users 13 years of age and under. While the VCDPA went into effect on January 1, 2023, this new update regarding children’s data went into effect January 1, 2025.

Over the last few years, there has been a growing interest by states in children’s privacy. Virginia recently enacted additional protections

Whether you are long overdue in developing a Virginia Business Privacy Program or if you want to update your existing Business Privacy Program, now is the time to get started in your 2025 data security and privacy planning.

The Virginia Consumer Data Protection Act and increased federal regulatory oversight mean each business has increasingly complex data and privacy legal obligations. With this new legal authority, the Virginia Office of Attorney General and federal authorities have stepped up enforcement actions.

And if the legal requirements are not enough, your Virginia or Washington, DC, business needs a Privacy Program to protect your clients, your employees, and your company’s interests from reputational and operational damage. A proactive program, rather than a reactive solution, is the key to navigating these challenges.
