ATTENTION H-1B VISA HOLDERS!

In light of President Trump’s Proclamation last night, if you or anyone you know holds an H-1B visa and is currently outside the U.S. we recommend entering the U.S. BEFORE September 21, 2025 at 12:01am. H-1B visa holders should consider not traveling internationally in the immediate future.

Here’s a quick summary of key points.

Effective September 21, 2025, the following measures will apply:
1. $100,000 Payment Requirement: Employers seeking to sponsor a H-1B worker who travels internationally into the U.S. must submit an additional $100,000 payment with the petition.
2. Applies Only to H-1B Seeking to Enter the U.S.: The $100,000 payment applies to H-1B visa workers seeking entry into the U.S. H-1B extensions and change of employer petitions within the U.S. are not impacted or subject to the new payment.
3. National Interest Exception: The government may waive the payment requirement if hiring the worker is deemed in the national interest and poses no security risk. Details about how to apply for a waiver have not been provided by the Trump administration.

In this weekend’s Times is a feature article about the rare release of a 47-year-old father of four whom the government is trying to deport to Laos. A federal judge ruled Friday the Department of Homeland Security must release him. Alan Phetsadakone left an immigration detention center Saturday morning.
