Patent Eligibility for AI can be a tricky subject to consider….The Courts have a judicial exception to all that can be patented….This exception includes abstract ideas, laws of nature, and natural phenomena…. These are what is known as the building blocks to human ingenuity…. Placing "Patent Pending" on a product's packaging and marketing materials Does Not protect the innovation behind the product… It may serve as a deterrent; but not a Shield....Once a patent application is Filed, then the concept is "patent pending." The Examination Process can take from 2 -3 years. During this time, some marketers choose to "blitz the market" in an effort to capture the market share no matter what the outcome of the Examination will be.. But we must learn the capacity to be fire walkers...
This takes discipline, empowering self-talk, and a lot of imagination…

UNITED STATES v. ARTHREX, INC. ET AL.
The U.S. Supreme Court has ruled that all Administrative Patent Judges (APJ) on the Patent Trial and Appeal Board are constitutionally vacant, requiring Presidential appointments and Senate confirmation to act as "principal officers" under Article II of the Constitution. The Court said their appointment is unconstitutional because the judges are appointed by the Secretary of Commerce and their Decisions on patent validity are insulated from executive review.
As a solution, the Court gave the Director of the U.S. Patent and Trademark Office the discretion to review decisions rendered by APJs.
This Decision applies only to Inter Partes Review, wherein the PTAB reconsiders whether existing patents satisfy the novelty and nonobviousness requirements all over again. (These types of proceedings are held in attempt to squash a patent infringement allegation)
What does this mean for you as a business owner?
Some believe that this may make your patents more difficult to invalidate (i.e. cancel)
The outcome remains to be seen. We can not predict for sure how the Board and the Director will rule going forward.
It will be interesting to see how the patent invalidation rate changes over the next year or so as a result of this ruling - are we going to see rates go up? Or down? Stay tuned for our next blog post…
