Another family ripped apart. My client was arrested by ICE this morning while driving to his landscaping job. He has lived in the US and paid taxes since 1996 and has NO criminal record. He's soft-spoken, generous to a fault, and has worked every day he was able in the 30 years he has lived here. He even took in a victim of trafficking and has supported her and her children for years. He was doing it "the right way" and could have had his papers in a few months. These are your tax dollars at work. Is this what you voted for?

I can't believe I am writing this. My clients who live in Washington DC are now living in occupation. To go to work, they have to pass through checkpoints guarded by federal agents. Even those who have lawful status or are dutifully following the law to obtain lawful status are being detained and interrogated because they are Latino--on the street, at their jobs, and at transportation hubs and airports. Someone who has won asylum status or resident status under the laws of this country should not have to fear being detained and interrogated. And those who do not have lawful status should be questioned with dignity, not violently kidnapped by masked agents and ripped away from their families. It seems the point of this administration's immigration policy is cruelty. Respect for human rights is what has always set this country apart from so many of the places from which my clients flee. Now I cannot see a difference. Those of you far away from D.C., I know this is all abstract to you. You may even wonder if it's actually happening. It is. Pay attention. And do something more than "like" this post.

This post from an immigration attorney colleague of mine needs to be shared. For all US citizens who follow my page and have the privilege of voting, this is being done in your name. You've seen the videos of ICE violently rounding up immigrants with no criminal records while at their jobs, while picking your fruits and vegetables in the fields, and while trying to attend their court hearings in order to immigrate legally. What you don't see is what is described below, because after ICE takes them, they subject them to unimaginable horrors they don't want you to see. Is this the America you want for you and your children?

This was never about illegal immigration. This was about shutting down the LEGAL immigration system so nobody is able to (or even wants to) immigrate anymore to this country. Cruelty is the point.

Alligator Alcatraz the horrors continue.

My client was told he was going to Krome [Detention Center] on Tuesday and then he disappeared in the system. I got a call from him today that he's at [Alligator Alcatraz] in the Everglades and the story about the transfer is horrific.

He was shackled with other men on a bus and driven to the facility, then left outside on the bus overnight, still shackled without food or water until midday the following day. A corrections officer eventually brought food and water to the bus but the men refused, demanding to be taken off the bus (which had a single bathroom but you can imagine the smell after a full day).

He describes the atmosphere inside as very tense, "about to boil over." That they are in dog pens and all treated like violent criminals. No one gets any information, they just call a name and the guy is never seen again. No rec, no showers, barely any light or air.

This morning I feel compelled to describe just how much the Trump administration is terrorizing my clients. Many of you are aware of the news stories of immigrants being snatched off the street and erosion of due process in immigration proceedings. This is not fake news. It is happening every day, and we, this country, are not okay. If their due process and freedom of speech rights can be taken away, so can yours.

Here are some highlights of the past two weeks:

1. My client, a trafficking victim, cancelled his appointment with me this morning because ICE is raiding his neighborhood and he's afraid to leave the house. He's also worried his boss will report him to ICE for not showing up to work today. He's lived here for almost 20 years and has suffered a stroke and kidney failure due to the harsh conditions in his job.

2. Another client with a strong asylum case was denied asylum and granted protection under the Convention against Torture by an immigration judge. Days later, ICE begin calling him in weekly for check-ins. He may soon be processed for removal to a third country where he knows nobody, like Mexico, Panama or Libya since his protection only keeps him from being returned to his home country.

3. All of my clients who have received work permits in the last month are now unable to use them because the Trump administration stopped all communication between USCIS and the Social Security Administration. That means my clients have to now access an appointment with the SSA in English and wait months for an appointment, where they will inevitably be told that the SSA has to verify their status with USCIS first. It's unclear whether they will ever receive a Social Security number and actually be able to work, even though the government has granted them work authorization.

4. An Afghan client and renowned musician and composer, who has been waiting for almost 10 years for his asylum interview was finally scheduled. Meanwhile, the Trump administration has deemed Afghanistan safe under Taliban rule.

5. My clients are being bombarded with propaganda on TV and social media about how they should self-deport. We know this is because the Trump administration simply doesn't have the resources to remove masses of immigrants, but the point is to terrorize and to make life as unpleasant as possible.

6. Clients call every day to ask if their US citizen children will be deported with them if they are deported. My pregnant clients are worried their children won't be considered US citizens even though they're born in the US.

7. Clients are afraid to file taxes with their current address because the IRS will share their information with ICE.

8. My amazing colleagues in the DC region have been at the forefront of the fight against the Trump administration for snatching people off the streets--international students who had criticized the war in Gaza and others like Abrego Garcia. ICE intentionally moved these detainees various times to remote detention facilities to keep them from having access to their attorneys.

Every day is a fight for our clients' survival and the survival of our democracy. What can you do? Speak out. Don't stand by and watch your country crumble in front of you. Attend protests. Befriend immigrants. And most importantly, VOTE in the midterm elections.

The appeal period has passed, so I'm happy to announce another asylum grant to a single mother and her school-aged son from El Salvador! She survived a harrowing experience when her former partner joined the MS-13, and after the gang turned on him, my client was threatened with death in retribution for her former partner's actions. My client also ran the risk of being arrested by the government of El Salvador, which has given broad powers to the police and military to sweep up anyone remotely related to gang members. Though the US government attorney fought hard against us, trying to prove that El Salvador is safe under Bukele's leadership, the judge understood that much of what Bukele presents publicly is a facade that hides the uptick in violence against citizens of El Salvador by its own government and the stripping away of due process. Congratulations to my client. May you and your son feel safety and peace in the United States.

Despite all the difficulties the Trump administration is creating even for legal immigrants, Brody Immigration Law was able to help three clients obtain their US citizenship this week! Many congratulations to these very deserving clients from Angola, Venezuela, and Colombia.

This new citizen in the photo is close to my heart because he has been my client since 2011! Though we've both moved to different states since meeting in New Mexico, he entrusted me to take him all the way to citizenship over a 14-year process. Today I am proud to call him my fellow American! Parabéns!

In response to the Trump administration's threats against immigration attorneys simply for doing our jobs, the American Immigration Lawyers Association (AILA), of which I am a member, has this to say. I wholeheartedly agree:

WASHINGTON, D.C. - The American Immigration Lawyers Association (AILA) rejects the assertion put forth in a memo sent out last night by the Trump Administration that there is “rampant fraud and meritless claims” being committed by immigration lawyers. Considering recent actions against judges, this is a chilling directive to the Attorney General Pam Bondi and the Secretary of Homeland Security Kristi Noem to act against immigration attorneys, law firms and the immigration bar. The memo, in short, orders sanctions, reviews, and stricter oversight of attorneys in asylum and immigration cases. The broad assertion that immigration attorneys are acting improperly in their efforts to represent individuals against an increasingly complex and restrictive immigration system is both unfounded and dangerous.

AILA President Kelli Stump stated, “First and foremost the American Immigration Lawyers Association (AILA) is a bar association dedicated to defending and respecting the rule of law. AILA members have taken a solemn oath to uphold the Constitution of the United States, to conduct themselves with integrity and civility, and to faithfully discharge their duties as officers of the court. For more than 75 years, AILA and its members have guarded this oath, and the integrity of the practice of immigration law. We remain steadfast in our commitment to upholding the highest standards of professionalism and integrity within our ranks and are committed to ensuring that all immigration attorneys meet their professional responsibilities. This administration’s rhetoric is not only misleading but dangerous. It seeks to delegitimize the work of resolute professionals who ensure that immigrants—many of whom are fleeing persecution and are contributing to their new communities—have access to fair legal representation. This is not just about immigration lawyers; this is about the integrity of our legal system and the principles of due process and equal protection under the law. AILA and its members will not be intimidated. We took an oath as attorneys, and political pressures will not dissuade us from that sworn duty to the constitution.”

AILA Executive Director Benjamin Johnson added, “The Trump administration has a long history of attacking judges who dare to rule against them and maligning the character of anyone who disagrees with them. Late last night, the Administration focused its ire on immigration lawyers and big law firms who take on pro bono cases. This is a dangerous assault on the legal profession. The role of attorneys is essential to a balanced system of justice in our democracy. Lawyers have an ethical obligation to zealously advocate for their clients within the bounds of the law. This duty is not only a cornerstone of our legal system but is also enshrined in the very fabric of American jurisprudence. Attempting to vilify immigration lawyers for fulfilling this duty is a cynical attempt to discourage due process and silence those who work to protect the most vulnerable among us. AILA will continue to work toward the creation of a safe, orderly, and humane immigration system, to defend the rights of immigrants, uphold the ethical obligations of our members, and challenge any effort that seeks to erode the principles of justice upon which this nation was founded.”

Estamos celebrando otra victoria de asilo esta semana para una familia hondureña! Esta familia fue vigilada y amenazada con muerte solo porque el hijo de la familia se cortó el cabello de una manera que cayó mal a la pandilla que controlaba su vecindario. Si los americanos en contra de solucitantes de asilo pudieran vivir un solo día dentro de un vecindario en Honduras controlado por la MS-13, entenderian exactamente por qué personas como mis clientes se huyen a los Estados Unidos.

We're celebrating another asylum victory this week for a Honduran family! This family was surveilled and threatened with death just because the son of the family cut his hair in a way that was distasteful to the gang that controlled their neighborhood. If Americans who oppose asylum seekers could live a single day within a neighborhood in Honduras controlled by the MS-13, they would understand exactly why people like my clients flee to the United States.

The good news just keeps coming! Congratulations to our most recent T visa grantee, who was trafficked into the United States as a domestic servant by diplomats after being sold into slavery at the age of 9. Now in her 30s, she is finally learning what it means to be free.

¡Las buenas noticias no paran de llegar! Felicitaciones a nuestra última beneficiaria de la visa T, quien fue traficada a los Estados Unidos como empleada doméstica por diplomáticos luego de ser vendida como esclava a la edad de 9 años. Two more grants of asylum! One for a government worker from Nicaragua who was monitored and threatened with death after attending anti-government protests; and another for a Honduran woman who was threatened with death by a gang after her cousin was murdered by the same gang. Neither client should have had to flee her home, but they came out of necessity to save their lives. We can only hope this country remains an oasis of protection, humanity and dignity for those who can no longer remain in their home countries. If you haven't voted yet and are a U.S. citizen eligible to vote, VOTE like my clients' lives depend on it, because they absolutely do.

¡Dos concesiones más de asilo! Una para una empleada del gobierno de Nicaragua que fue vigilada y amenazada de muerte después de asistir a protestas contra el gobierno; y otra para una mujer hondureña que fue amenazada de muerte por una pandilla después de que su primo fuera asesinado por la misma pandilla. Ninguna de las dos clientes debería haber tenido que huir de su hogar, pero vinieron por necesidad para salvar sus vidas. Solo podemos esperar que este país siga siendo un oasis de protección, humanidad y dignidad para aquellos que ya no pueden permanecer en sus países de origen. Great news to start out the week! An asylum win for a courageous woman from Nicaragua, who stood up and protested in support of her country's most vulnerable when the government tried to silence them. Her Catholic faith led her to protest what she knew was wrong, and as a result, she was threatened with death by government-sponsored paramilitaries. Now she and her daughter are safe and can live out their political and religious beliefs without fear. Welcome to the United States!
