New York’s expanded access to lifetime DMV driving records has dramatically changed the way traffic and DWI cases are handled in court.
Judges and prosecutors can now review far more than just current charges or active points, including prior reductions, plea agreements, suspensions, and long-term driving history. Even violations from many years ago can still impact how a case is viewed today.
As a result, it has become increasingly difficult to negotiate favorable plea agreements in many traffic-related matters, particularly for drivers with prior history. Cases that may have once been resolved with lesser reductions are now facing much stricter scrutiny.
Many drivers are unaware that prior plead-downs and dispositions can continue to follow them long after they believe a matter was resolved. Understanding the long-term impact of traffic and DWI matters has never been more important.
