Oregon firearm owners were just handed a long-delayed victory.

For nearly two years, clients have paid to have their rights to firearm ownership restored through Oregon's set-aside process (known often as "expungement") only to find the State was reviving set-aside charges and using them as a basis for denial.

During that time, many came to our office complaining of being delayed and/or denied when attempting to purchase a firearm. My office could never get answers directly from OSP, but a leaked memo revealed Oregon was refusing to acknowledge set-asides, despite the court order standard to each set-aside. It was a brazen rejection of a court order, but until now, they refused to follow it.

The State has now conceded in court and will once again recognize set-asides as restoring firearm rights.

Oregon State Police has directed that set-asides (commonly known as "expungements") are no longer being recognized for firearm transfer purposes. It's likely if you have petitioned the court for a set-aside recently, you will not be able to purchase a firearm.

To be clear, this is not law. It is an agency decision that will be challenged in court. Further, what the state is doing directly violates the court order issued to the Oregon State Police in every set-aside, which directs them to seal and set-aside the record of arrest and conviction.

Although I try not to spam with TEDTalk types of materials, many do not realize the importance of children having good advocates in the system. This morning the Oregon Attorney General’s office asked the Oregon Supreme Court to stay (or stop) a Temporary Restraining Order issued by a Harney County judge.

The Oregon Supreme Court denied the Oregon AG’s request. As of now, the TRO is in effect and the provisions of 114 will not go into effect until the State can show cause why it should otherwise be allowed to enforce it.

As of tonight, the soonest Measure 114 will become law will be December 13. Updates to follow.

This morning a judge in a federal case denied a motion to stay the new Measure 114 law in Oregon. That judge did extend the permit-to-purchase program for 30 days meaning that the current backlog of firearm sales can continue for 30 days.

Hours after, a judge in Harney County granted a temporary restraining order that “froze” all the effects of Measure 114 from being implemented until and unless the State can show good cause why the law should go into effect.

The practical effect is this: until December 13, 2022, gun sales can resume and FFL dealers can transfer fi****ms after 3 full business days if no answer is returned from a background check; higher capacity magazines can be sold; and law enforcement cannot enforce the provisions prohibiting such fi****ms.

The State can take the matter up on interlocutory appeal and the Oregon appellate courts could reverse the Harney County decision.

Per the Governor’s Order, masks are required for visitors to the office.

Juvenile Delinquency and Dependency cases are still being held remotely unless otherwise noted.

If your court date is in-person, the courts are requiring masks irrespective of vaccination status.

With the Governor of Oregon lifting all Covid-19 restrictions statewide, courts will resume to be in-person by default. If you are a client, please prepare for all court proceedings to be in-person, even if you were provided an access code to a remote hearing.

The Chief Justice has continued to extension of timelines in certain cases, but those largely do not apply to any of our current clients.
