We have been retained to represent Josh Soden—an extraordinary person who has been tragically and catastrophically injured due to the reckless actions of a drunk driver. He is fighting for his life in a coma at Albany Med, in such critical condition that he cannot be moved to get an MRI performed.
In addition to the drunk driver, we believe several other individuals may bear responsibility for over-serving the drunk driver. We will pursue the truth with meticulous care and uncompromising resolve. We will aggressively follow the evidence wherever it leads and we will not be intimidated by reputation, influence, or iconic status—even though the restaurants involved are well-known Saratoga establishments. We have no fear and no hesitation to act against anyone the evidence shows is responsible. No one is above the law.
We understand that one of the restaurants involved is actively instructing employees not to provide information. If true, this despicable conduct is unacceptable and may be illegal as witness tampering. Every employee—and any other individual—has an absolute right to cooperate with law enforcement or with our firm’s investigation. No one should be intimidated into staying silent or, worse, asked to destroy evidence. Destruction of evidence (texts, photos, etc.) will be dealt with swiftly. It is worth noting that the driver at the scene tampered with evidence by trying to have a coworker at the restaurant get rid of a white claw she had outside.
