(Remember David got the anointing of becoming a King while he was a simple child herding sheep. Esther was a simple orphaned girl yet she was a Queen in waiting). *I suspect that the late Hon Prof. NSIBAMBI's choice of bequeathing his property to his blood daughters and Making the Eldest of them their Heir,(despite of Him being a renown Monarchist ) was influenced by his confidence in Their protection enshrined in Honest 1995 constitution of the public of Uganda(as one of the people who birthed it) should the kyiiganda culture raise it's Gender card.!!*

*One of the most honest laws Uganda has, is her 1995 constitution.* notwithstanding the fact most of the amendments of it's provision have generated controversial debates(i.e *five amendments-Act No. 13 of 2000, Act No11/05, Act No. 21/05, Act No. 12/15 & Constitution (Amendment) Act of 2017

not only in corridors of power but also in the entire public domain.

That as it may, allow me draw your attention to the issues of succession, inheritance and cultural norms & practices in the Eyes of 1995 constitution which is the grund norm from which all other norms derive validity. Any law, norm, or practice that is in contradiction with any of the provision of this Grund norm is not only null but also void ab initio.

The Argument advanced by the KYIIGANDA culture diehards is that in Buganda, the female cant be the heir, the heir must be a male.

It is paramount to ascertain whether the office of the heir (omusika) such a person/office is substantially administrative( just an overseer) mandated with responsibility to see hw the property of the deceased is bequeathed to all the beneficiaries or whether such an office/person is to whom such property is bequeathed and it's upon him/her to utilize the property as him/her deems it fit. What ever the case may be since am not well versed with the kyiiganda cultural practice and norms, I will avoid to authoritatively conclude on this matter with a cultural argument. I will discuss it legally restraining my self to the spirit of the 1995 constitution. Good enough it's this constitution all other discussions shall be finally settled legally but not in the traditional meetings at Burange

In the present case The late Hon. Prof.NSIBAMBI(R.I.P) willed and bequeathed his property to his 4 daughter. In the will, The late appointed his eldest Daughter as the heir( which most of the people have since interpreted as customary heir)

Alternative dispute resolution (ADR) on the international scene has long been used throughout the court systems around the world significantly reducing court backlog. In light of its settlement results, the method has also been applied by both the private and public sectors.

Therefore, time and money that would otherwise be spent in costly and lengthy litigation, have been saved. In Uganda, the method is not so common, but things are changing.

ADR refers to methods of dispute settlement that do not involve litigation in the courts. The ADR mechanisms are arbitration, mediation and conciliation. Long before ADR was introduced into our judicial system, there already existed mechanisms of conflict resolution in many cultures.

The aim of dispute resolution then was to restore peace, keep the concept of community alive and the tribe together. It focused on encouraging reconciliation and restoring the relationship of the parties.

Whenever there was conflict, the parties usually sought the aid of a third party to help them arrive at a solution.

This third party was often someone respected in the community, whose opinion was valued and was either a chief, an elder or a person known to be wise. This was the manner in which everything was handled, including what would now be considered a criminal matter in today’s judicial system. (A good example found within the Lango culture of northern Uganda).

Mediation program in Uganda:-
Mediation program is na alternative dispute resolution mechanism that allows parties entangled in a dispute find a quick solution with the assistance of neutral third party.This process avoids the costly and lengthy court process.

The judicature act cap 13 provides for ADR under sec 26 to 32 of the act which provides for situations when matters can be referred to special referee or arbitrator to handle where such official has been granted High court powers to inquire and report in any cause or matter other than a criminal proceeding

Mediation happens only when both parties agree to meet with the mediator to settle a dispute that falls within the jurisdiction of the court.

Conflicts may be resolved peacefully, however sometimes it results in the use of force where there is armed or violent conflict.
