I can name over 50 forms of injustices in Africa that go unnoticed. Who is to blame?

About 3 in 10 people don't know their basic fundamental human Rights in society. The few who claim to know, don't know the right avenues to address these issues.

Is the justice system broken and unable to educate the masses? We stand behind the law and claim that "Ignorance of the law is no defence" to justify placing an affected illiterate farmer behind bars.

There are defenses for Negligence liability.

For example, if you notice that a bottle of fruit juice has spilled in the aisle of your grocery store and you block off the aisle with a rope and put up a sign reading, "Danger: Do Not Enter," and a customer ignores the sign, removes the rope, then injures himself, you can defend against liability by stating that the customer assumed the risk by disregarding the warnings you put in place.

Lack of legal awareness is one of the challenges of access to Justice in Uganda..

Where the users of justice institutions lack sufficient information to seek redress. There is general lack of information on the mandates and procedures of the JLOS institutions in languages that people understand. Court use legal jargons, the formality of the processes and technicalities also hinder access to justice This has multiple effects including but not limited to loss of interest in pursuing the justice process due to unclear outcomes, manipulation of duty bearers and intermediaries, poor presentation prolonging the realization of outcomes, delayed and therefore failed justice.

Reality: Not everyone gets caught, but someone does. The hosts on a NJ radio talk station described being pulled over for speeding as a โ€œreverse lotteryโ€ where many people are doing it alongside you, but only one car gets singled out and pulled over. โ€œWhat about all those other guys?โ€ is not a defense.

How does a bill become a law? A bill becomes a law after it has been passed in the same form by both houses of Parliament and is signed by the President.

So don't panic when you hear a bill in process.... It is not yet a law, there are procedures to be followed before it's made a law.

Legislative Process in Uganda.

The legislative process in Uganda takes various systematic steps when legislation is being proposed

The legislative process takes the following steps when legislation is being proposed by a Ministry or Government Department in Uganda โ€“

1. The Ministry concerned approaches Cabinet through a Cabinet Memorandum with a proposal for Cabinet to approve the principles for the drafting of the Bill. Cabinet approval in principle is required before drafting of the subject legislation. This is provided for under paragraph 2 of Section (Q-b) of the Uganda Public Service Standing Orders, 2010.

2. Paragraph 2(b) of Section (Q-b) however permits a Bill to be drafted by the First Parliamentary Counsel if the Attorney General or Solicitor General authorises the drafting of the Bill without reference to Cabinet. According to the paragraph, this authority should be granted only in special circumstances. The request for the authority should be made through the responsible Minister.

3. Cabinet then considers the proposals as contained in the Cabinet Memorandum of the Ministry concerned and approves the principles on the basis of which a Bill is to be drafted.

4. When Cabinet approves the principles for the drafting of a Bill, it authorises the responsible Minister to issue drafting instructions to the First Parliamentary Counsel/Attorney General to draft the necessary legislation.

5. The Ministry concerned would then request the First Parliamentary Counsel through the Attorney General to draft the legislation on the basis of the approved principles as contained in a Cabinet Minute.

6. Where the instructions are not clear, the First Parliamentary Counsel will ask the Ministry concerned for further instructions and where necessary request that Ministry to identify an officer in the Ministry to liaise with the office of First Parliamentary Counsel in the drafting of the Bill.

We introduce to you Mr. Kiyimba Shafik the Human resource manager of Unchained YOLAW. He is a law student at Makerere University, Shafik is an activist for human rights, social justice and good governance. Shafik is a philanthropist who loves to see change in people's lives. He is the former deputy director of programs at the Uganda secondary Schools Prefects Association (USSPA). He believes that the law is a path to development not oppression.

Chapter III of the Penal Code Act of Uganda, Cap. 120 provides for the general rules as to criminal responsibilty.
Today we look at Section 6, which states that Ignorance of law is no defense.
Ignorance of the law does not afford any excuse for any act or omission
which would otherwise constitute an offence unless knowledge of the law bythe offender is expressly declared to be an element of the offence.

At the end of the day, when caught by law makers for breaking the law, you may not be able to defend yourself as to have not known the law. Read the law, know the basic law, and speak up.

Are you so sympathetic? Or do you know anyone that is....Recently the lawmakers in Uganda have passed a bill making it a criminal offence to offer money, food or a donation to a street child. Violators of this new law could face up to six months in jail or a fine of Shs41,350 (about $11). The aim of the law is to curb the commercial and sexual exploitation of children.

A gift inter vivos, which means between the living in Latin, is a legal term that refers to a transfer or giftmade during the life of the grantor.Inter vivos gifts, which includes property related to an estate, are not subject to probate taxes since they are not part of the donor's estate at death.
What does this mean? That a gift ( in this case can be land, gifts at a marriage ceremony, any other item deemed a gift) can not be revoked. Unless the giver states the period in which it is to be used and returned. It is inevitable to make this promise in writing for purpose of proof. Therefore once a gift is given to the receiver without limitation, the owner can not claim for it. Gift inter vivos.
