Public smokers to be arrested

Starting today, anyone found smoking in public will be arrested as the To***co Control Act takes effect. The To***co Control Act 2014, which was passed into law last year, criminalizes buying a stick of cigarette for a person below the age of 21, to sell or operate tobacco-related products or smoke a cigarette within 50 meters of a public facility or in places such as schools or hospitals.

Therefore If found smoking within 50 feet of a public facility or in enclosed areas, a person will pay a fine of Shs200,000 or be arrested and jailed for five months or both depending on what the judge decides. However it’s said that after six months ending November, the entire law will be implemented. (Source: daily monitor 18 may 2016)

Defilement of persons under eighteen years of age

Any person who performs a sexual act with another person who is below the age of eighteen years commits an offense called defilement and is on conviction liable to life imprisonment.

Government will soon table the Witness Protection Bill in Parliament, the director of Public Prosecution (DPP) Mike Chibita, has said.
The judiciary faces challenges of witness compromise and backlog of cases. He explained that most of these challenges were due to lack of laws that protect people or state witnesses in the courts of law.
"There are many instances where the state loses cases due to hostile witnesses or compromises. Some of them fear to come and give evidence on behalf of the state fearing that the public will harass them”. As the country gears up for the forth coming general elections, the president has urged judges to be impartial while hearing pool related petitions. This was said in the president’s speech read by Prime Minister Ruhakana Rugunda during the opening of the annual judges` conference at the common wealth resort hotel in Munyonyo.

The speech’s theme was “promoting the rule of law through judicial accountability and excellence”.

The theme reinforced the cardinal principles that an effective, efficient and accountable judiciary can observe and uphold in respect to the rule of law in civilized societies.

At Muslim Centre for Justice and Law, we associate ourselves with the words of His Excellence the President of Uganda that “justice should not only the done but be seen done by the judiciary.”

INNOVATIONS IN THE JUDICIAL PROCESS
The judiciary is in the process of introducing video testimonies for witnesses as well as an on line filing system of cases. The procedure in courts has always been that witnesses have to make personal appearances physically before court to give evidence. This is amidst the financial constraints as well as threats to their lives attached to them laboring to come to court.
To save all these huddles a new system is yet to be in force where witnesses for example children who are victims of sexual gender based violence shall appear in court by video link to save them secondary victimization which they suffer to testify in full view of their alleged molesters.
This new system will also come with the Online filing system of court documents and cases which will also see advocates file their cases from their chambers without coming to court. This will be convenient, time saving as well as uplifting professional conduct of cases.
This was said by the Chief justice at the opening of the New Law year at the Kampala High court.

In September 2015, world leaders came together to unanimously agree to a new set of goals that would guide sustainable development for the next 15 years.

The Sustainable Development Goals (SDGs) replace the previous goals, the Millennium Development Goals (MDGs) which were created to tackle some of the most challenging issues then faced in development such as enrolling children in school, reducing infant, child, and maternal deaths.

There has been significant progress in the areas targeted by the Millennium Development Goals (MDGs) yet there is also much unfinished business. Child poverty is rising and has been linked by the International Labour Organisation to falling levels of maternal and child benefits.

The good news is that our world has more wealth, more knowledge, and more technologies like the E-LAW Uganda APP at its disposal than ever before. These technologies can help us make justice and law accessible and fair for children

The law protects the interest of the wife on the death of the husband in the deceased’s property.
Where the husband dies intestate (without leaving a will), and leave behind a customary heir (primary heir), a wife, lineal descendants (children and grandchildren) and dependents’ (people who were entirely dependent on the deceased- they may be relatives or not).
The customary heir receives 1 %, the wives will receive 15%, and the dependents receive 9% and the lineal descendants 75% of the whole property.
Where the deceased is survived by a customary heir, a wife, and a dependent relative but no lineal descendant, the customary heir receives 1%, wife receives 50%, the dependent relatives receives 49%.
Where the intestate is survived by the customary heir, a wife or a deceased’s relative but no lineal descendant, the customary heir shall receive 1%, the wife or dependents, receive 99%.

The laws of Uganda i.e. the Constitution, the Land Act and the Registration of Tittle’s Act, recognizes both the lawful and Bonafide occupants (Bibanja holders. These include People who occupy land as customary tenants whose tenancy was not disclosed or compensated for at the time of acquisition of the leasehold certificate of tittle, a person who entered the land with the consent of the registered owner and a person occupying land by virtue of the repealed Busuulu and Envujjo laws of 1928, Toro land lord and tenants laws of 1937 and Ankole landlord and Tenants Law of 1937.

Under section 34 of the Land Act, the above are accorded powers to assign, sublet, pledge, create third party rights, subdivide, and undertake any other transactions in respect of the occupancy.

The same Act (Land Act) Section 33 may apply to the registered owner and be issued a certificate of occupancy.
