Public smokers to be arrested

Starting today, anyone found smoking in public will be arrested as the To***co Control Act takes effect. The To***co Control Act 2014, which was passed into law last year, criminalizes buying a stick of cigarette for a person below the age of 21, to sell or operate tobacco-related products or smoke a cigarette within 50 meters of a public facility or in places such as schools or hospitals.

Therefore If found smoking within 50 feet of a public facility or in enclosed areas, a person will pay a fine of Shs200,000 or be arrested and jailed for five months or both depending on what the judge decides. However it’s said that after six months ending November, the entire law will be implemented. (Source: daily monitor 18 may 2016)

Defilement of persons under eighteen years of age

Any person who performs a sexual act with another person who is below the age of eighteen years commits an offense called defilement and is on conviction liable to life imprisonment.

Government will soon table the Witness Protection Bill in Parliament, the director of Public Prosecution (DPP) Mike Chibita, has said.
The judiciary faces challenges of witness compromise and backlog of cases. He explained that most of these challenges were due to lack of laws that protect people or state witnesses in the courts of law.
"There are many instances where the state loses cases due to hostile witnesses or compromises. Some of them fear to come and give evidence on behalf of the state fearing that the public will harass them”. As the country gears up for the forth coming general elections, the president has urged judges to be impartial while hearing pool related petitions. This was said in the president’s speech read by Prime Minister Ruhakana Rugunda during the opening of the annual judges` conference at the common wealth resort hotel in Munyonyo.

The speech’s theme was “promoting the rule of law through judicial accountability and excellence”.

The theme reinforced the cardinal principles that an effective, efficient and accountable judiciary can observe and uphold in respect to the rule of law in civilized societies.

At Muslim Centre for Justice and Law, we associate ourselves with the words of His Excellence the President of Uganda that “justice should not only the done but be seen done by the judiciary.”

INNOVATIONS IN THE JUDICIAL PROCESS
The judiciary is in the process of introducing video testimonies for witnesses as well as an on line filing system of cases. The procedure in courts has always been that witnesses have to make personal appearances physically before court to give evidence. This is amidst the financial constraints as well as threats to their lives attached to them laboring to come to court.
To save all these huddles a new system is yet to be in force where witnesses for example children who are victims of sexual gender based violence shall appear in court by video link to save them secondary victimization which they suffer to testify in full view of their alleged molesters.
This new system will also come with the Online filing system of court documents and cases which will also see advocates file their cases from their chambers without coming to court. This will be convenient, time saving as well as uplifting professional conduct of cases.
This was said by the Chief justice at the opening of the New Law year at the Kampala High court.
