АНТЕ СУПРОВОДЖУЄ ПЕРЕДАЧУ КВАРТИР У ДЕРЖАВНУ ВЛАСНІСТЬ ДЛЯ ПОДАЛЬШОГО НАДАННЯ ПРИЙОМНИМ СІМ’ЯМ

Юридична фірма Анте надає правову допомогу латвійській компанії AS “Amber Assets” в проекті передачі дев’яти квартир у новобудові в м. Дніпро з приватної власності компанії у державну власність.

15 вересня 2025 року відповідне рішення ухвалено Кабінетом Міністрів України.

Квартири передаються уряду України відповідно до Постанови Кабінету Міністрів Республіки Латвія №524 від 26.06.2024.

Передача активів із приватної у державну власність є нетиповою, неврегульованою та складною процедурою. Виявилось, подарувати щось державі – не просто.

Квартири

Уряд погодив пропозицію AS “Amber Assets” про безоплатну передачу дев’яти квартир в новозбудованому будинку на набережній в м. Дніпро у державну власність з віднесенням їх до сфери управління Міністерства соціальної політики, сім’ї та єдності.

Кому будуть передані квартири

Квартири надаються прийомним сім’ям із числа тимчасово переміщених (евакуйованих), новостворених або тих, які потребують поліпшення житлових умов, за умови, що у сім’ї відсутнє власне житло на території, яка не належить до територій активних бойових дій та/або тимчасово окупованих, що включені до відповідного переліку або їхнє житло зруйноване чи непридатне для проживання.

Міністерство соціальної політики, сім’ї та єдності має опрацювати питання передачі квартир таким сім’ям.

SUPERNOVA AIRLINES ГРУПИ КОМПАНІЙ NOVA – РОЗУМНІ ЗАПАСЛИВІ ОПТИМІСТИ

ЩО СТАЛОСЬ?

1. Українські медіа вчора та сьогодні вибухнули заголовками на кшталт «у Львові та Києві запрацюють аеропорти для «Нової пошти»». Такі заголовки є неправдивою інформацією.

2. Інфоприводом став вчорашній наказ Державіаслужби України яким авіакомпанії Супернова Ейрайнз надано права на експлуатацію повітряних ліній: Львів – Прага (Чеська Республіка) – Львів (частота рейсів: 7 рейсів на тиждень); Київ – Прага (Чеська Республіка) – Київ (частота рейсів: 7 рейсів на тиждень) для виконання регулярних міжнародних повітряних перевезень з/до України, із визначенням строку дії прав: з 01.11.2024 на необмежений строк.

3. Надання прав на експлуатацію повітряних ліній не означає, що такі права будуть чи можуть використовуватись. Повітряний простір України повністю закритий і це не змінилось.

4. Мінінфраструктури (чи як там воно зараз називаться) під вечір сьогодні навіть офіційно спростувало інформацію про відновлення повітряного сполучення в України.

НАВІЩО ЦЕ СТАЛОСЬ?

5. Супернова – молодці. Навіщо отрималиправа? Бо можуть. Бо мають сертифікат експлуатанта.

6. Справа в тому, що досі діють двосторонні угоди про повітряне сполучення з певними обмеженнями у частотах, пунктах куди можна літати та кількості перевізників, що можуть призначатись на певні лінії. За ці права у мирний час завжди буде страшна конкурентна боротьба. Найвідомішим прикладом є рейси в Стамбул. Всі туди хотіли літати, а права були здебільшого у МАУ.

7. Зараз виникла ситуація, коли всі права на лінії з обмеженнями або вже вільні, або звільняться. Уявіть собі, що всі права МАУ тепер вільні.

8. Для повітряних ліній між Україною та Чехією діють такі обеження: Київ – Прага – 10 рейсів на тиждень для авіакомпаній кожної сторони. Одеса – Прага 7 рейсів на тиждень сукупно для обох сторін. Інші регіональні – 7 рейсів на тиждень сукупно для обох сторін за кожним окремим маршрутом. Вантажні – 7 рейсів на тиждень.

9. Супернова забрала всі 7 з 7 можливих рейсів Львів-Прага та 7 з 10 Київ-Прага з 01.11.2024.

10. Нездійснення авіаперевізником експлуатації повітряної лінії, щодо якої надано право, протягом 12 місяців є підставою для анулювання права на повітряну лінію. Також підставою для анулювання прав є втрата сертифікату експлуатанта. В Україні залишилось тільки декілька авіакомпаній яким вдалось зберегти сертифікат і продовжувати польоти. І Супернова яка примудрилась сертифікуватись під час воєнного стану. Це неабияке досягнення.

11. Тепер у Супернови неможливо забрати права на польоти до Чехії до 01.11.2025. Якщо повітряний простір у 2025 році буде відкрито то у Супернови вже будуть права, а іншим авіакомпаніям треба буде ще довго мучитись з сертифікатами та отриманням прав.

12. Стратегічно варто очікувати що Супернова буде намагатись підтримувати портфоліо прав на повітряні лінії з обмеженнями з горизонтом в один рік.

13. Коли відкриють повітряний простір нас очікує великий перерозподіл найсмачніших прав на повітряні лінії. І Супернова вже бере в цьому участь.

14. Можу тільки зауважити, що малоймовірним є запуск роботи аеропортів в перші три-шість місяців після завершення воєнного стану. А щоб уникнути анулювання прав на повітряні лінії треба буде майже одразу їх полетіти. Тобто конкуренти при бажанні зможуть поборотись і за ті права, які наперед збере Супернова чи СкайАп.
