Attention: scammers!
The legal company EXPATPRO presents its activities on the Internet only at the official website https://expatpro.co/, as well as social networks:

Recently, we received reports of interaction with a fraudulent organization that copied our company's website. Ukrainian police rejected our claims about the fact of fraud, as the representatives of our team are not direct victims of scammers and there are no proven losses.
We also filed a DMCA complaint, but the scammers restored the fake website in a while.
Last week, we knew that scammers imitating us created the NATO-Ukraine Relief Commission website. The Ministry of Internal Affairs of Ukraine has no information about any such program (here is a link to the official website https://mvs.gov.ua/uk). There is no NURC registration data (legal entity number, bank account) in the registers, etc., from which we conclude that such an organization does not exist.
We add screenshots of scammers’ resources not placing their links to avoid increasing the reputation of these fake sites. Please check out the screenshots below!

Our team has previously complained about blocking these sites, also our experts are solving the issue in the online field. We will continue to do so in the future if individuals or organizations use our name.

TRPs cannot be exchanged beyond the usual deadlines, as well as the extension of the stay in Ukraine.

Foreigners who have not adhered to usual migration rules on renewing TRPs and PRPs in prescribed terms (15 business days till the date of the document`s expiry date) will not have the opportunity to apply for renewing TRPs and PRPs*.

Previously it was possible to apply for an extension with a delay or over the term of the document validity due to the quarantine excuse.

The same situation will be with the procedure of the prolongation of terms of legal stay in Ukraine. Those foreigners who have not adhered to migration rules on the application for the prolongation of terms of legal stay in Ukraine in prescribed terms (from 10-th to 3-rd business day till the last day of the legal stay) will not have the opportunity to apply for this procedure.

We emphasize that the Law of Ukraine “On amending the legislative acts of Ukraine related to the problem of coronavirus disease (COVID-19)” still cancels the liability for foreigners (the fine) who violated the allowed terms of stay in Ukraine, have not applied for getting or renewing TRP, PRP in time during quarantine.

As of August 7, 2021 there would be no opportunity to extend your terms of stay in Ukraine, renew your TRP, PRP if you have missed the prescribed deadlines.

*The Government of Ukraine has recently adopted the Decree №757 as of July 21, 2021 “On amendments to the paragraph 2 of the Decree of Cabinet of Ministers of Ukraine №259 as of March 18, 2020” that comes into force on August 7, 2021.

Attention as of 01.07.2021, it is obligatory to make a rapid antigen COVID-19 test on the State border of Ukraine and to get a negative result, if the foreigner arrives from the Republic of India, the United Kingdom of Great Britain and Northern Ireland, the Russian Federation, the Portuguese Republic or the foreigner stayed there for at least seven days within last 14 days.

In case of positive rapid test result or foreigner`s refusal to make a test, State border service cannot let the foreigner cross the border.

The mentioned rule does not apply to:
1) foreigners and stateless persons, who are under the age of 12;
2) foreigners and stateless persons permanently residing in Ukraine,
3) persons recognized as refugees,
4) persons in need of additional protection,
5) employees of foreign diplomatic missions and consular institutions, missions of official international missions, organizations accredited in Ukraine, and members of their families,
6) drivers and crew members of freight vehicles, buses engaged in regular, irregular and pendulum transportation, members of air and sea crews, river vessels, members of train and locomotive crews,
7) servicemen (units) of the armed forces of NATO member states and participants in the NATO "Partnership for Peace" program, who take part in training events for units of the Armed Forces.

Citizens of Ukraine and foreigners permanently residing in Ukraine, which arrive from the Republic of India, the United Kingdom of Great Britain and Northern Ireland, the Russian Federation, the Portuguese Republic or stayed there for at least seven days within last 14 days, can make a rapid antigen COVID-19 test on the State border of Ukraine and in case of the negative result they will not be obliged to keep a self-isolation for 14 days. Or they can refuse to make a test and to keep a self-isolation for 14 days.

Test points for the detection COVID-19 antigen are located in the border control zones of State border service checkpoints.

Ministry of Finances of Ukraine has finally adopted (https://www.kmu.gov.ua/news/minfin-zatverdiv-formu-rozkrittya-strukturi-vlasnosti-yuridichnih-osib) the forms for ownership structure. That means, that starting from July 11, 2021 when the new business entity is registered it will be necessary to provide the UBO`s documents and the legal ownership structure.

Moreover, starting from July 11, 2021 a 3—month period starts (particularly for the directors of the existing legal entities registered prior April 28, 2020) to submit the first ownership structure.

Digital Transformation of Residence Registration💡

Yesterday the Ministry of Digital Transformation announced the procedure of electronic residence registration. Last week, the Verkhovna Rada of Ukraine registered a draft law On the Implementation of Public Electronic Services for Registration and Declaration of Residence. The Ministry of Digital Transformation declares that this project would abolish certificates of residence registration and simplify the residence registration procedure.

Summary of planned changes:
👉The project introduces the concept of "residence declaration". The declaration will be analogous to the already known registration.

👉Registration of residence will result from the residence declaring.

👉According to the draft Law, a person will be given the opportunity to declare (register) residence through an electronic portal. To do so, one will need to register on the state portal of electronic services and fill out an application through the personal account, attaching copies of identity documents, housing documents, and the real estate owner's consent to register. The opportunity to declare (register) residence through centres of administrative state services (CNAP) also remains.

👉To declare (register) a place of residence in the apartment / house that is not owned / co-owned by a person the consent of the homeowner is required! We emphasize that the residence declaration (registration) is impossible without the consent of the apartment / house owner. The novelty is that such consent of the homeowner can be provided by signing an electronic application.

👉The list of documents to be submitted for registration has been extended. For example, foreigners and stateless persons, who have received a temporary or permanent residence permit, will have to submit a passport and a notarized translation of the passport pages containing their personal data, in addition to the permit.

👉The administrative fee rates for registration and deregistration of residence are planned to be doubled, but if a person performs these two actions at once, only one of them will be charged.

👉The certificates of residence registration will no longer be the result of the residence registration service. The result of the service will be the notification via phone or e-mail. A Certificate of Residence Registration (or, in a new way, an Extract from the Register of the Territorial Community) will be available only as a separate service. It will also be possible to obtain an Extract from the Register through the electronic portal.

👉Some laws will be amended to abolish the submission of certificates of residence registration and to make certain state guarantees available irrespective of a person’s place of residence (e.g. an application for pension or social benefits can be submitted in any region regardless of the place of residence; medical care will also be provided regardless of the place of registration of the person).

👉If the place of registration is changed electronically, the state authorities will pass information to the Ministry of Internal Affairs for deregistration and putting on military records.

The Verkhovna Rada adopted the Law “On Amendments to Certain Legislative Acts of Ukraine Concerning the Improvement of Certain Issues of Military Duty and Military Accounting” and the law has recently entered into force.

The law provides for a number of changes in the Labor Code and the rules of employment, in particular:
▪ military registration document will become mandatory for employment;
▪ ex-servicemen will be given the preemptive right to stay on redundancy;
▪ Conscripts will be guaranteed to retain their jobs, positions and average earnings during the special period.

Fines for violating the procedure of keeping military records of employees were increased. According to Article 210-1 of the Administrative Code, setting a fine for violations of the legislation on defense, mobilization training and mobilization on citizens from 1700 to 3400 UAH and on officials - from 3400 to 5100 UAH. The same violations committed within the special period will result in fine un the amount from 5100 to 8500 UAH imposed over the officials.

NEW RULES ON THE VISA APPLICATION PROCESS: BIOMETRIC DATA COLLECTION IS REQUIRED☝🏻

On March 23, 2021, the Law №1328-IX was signed. According to it foreigners are obliged to provide their biometric data in the process of visa application, unless otherwise provided by law or current international agreements.
Not submitting the biometric data will be a ground for the refusal in Ukrainian visa🙅🏻‍♀️

Indeed, as stated in the explanatory note to the draft, the visa was the only stage of the migration process, where the biometric data were not collected. Biometric data have been already collected by the state bodies of Ukraine during: border control procedures; application for temporary / permanent residence permits; arrest and forced expulsion, etc.

🧬Biometric data collection is a well-known worldwide practice - biometric data are collected for visas in the UK, USA, Schengen countries etc.
The adopted law, on the one hand, will fill the gap in the regulation of migration processes and will allow to:
— simplify the process of foreigners identification during their entry to Ukraine;
— improve the control level over migration flows by state bodies;
— intensify the fight against the use of forged documents.

👀But on the other hand, such innovations will lead to the delays in the visa procedure, which may paralyze the work of Ukrainian consulates in some countries.

📌The abovementioned innovation should start working in six months from the date of publication, i.e. on September 26, 2021.
The procedure of collecting biometric data will not work without appropriate changes to bylaws. Therefore, we expect the Cabinet of Ministers of Ukraine to adopt amendments to the Rules of visa application for entry to Ukraine.
