The Legal Aid Secretariat (LAS) is a body established to coordinate the Legal Aid Providers in Tanzania. LAS operates under the leadership of the Legal Aid Providers. Currently LAS is funded by the pool of donors through the Legal Sector Reform Program (LSRP) basket fund. While LAS is a result of long negotiations among the LAPs and the government on the establishment of the governing body that wi

ll oversee and coordinate the provision of legal aid services in Tanzania, LAS functions under the Steering Committee which works as a governing board to the LAS Secretariat. The Steering Committee is comprised of the representatives from the LAPs organizations and is responsible to foresee the work of the LAS. At the moment Steering Committee is comprised of Seven (7) members from various LAPs organizations which are Tanzania Women Lawyers association (TAWLA), Legal and Human Rights Centre (LHRC), Women Legal Aid Centre (WLAC), Legal Aid Clinic of the School of Law of the University of Dar Es Salaam (LAC – UDSM), Disabled Organization For Legal Aid and Social Economic Development (DOLASED), Tanzania Paralegals Network (TAPANET) and Tanganyika Law Society (TLS).The Steering Commitee is currently being chaired by WLAC.

On 31st January 2017, The Parliament of the United Republic of Tanzania passed the Legal Aid Bill 2016 to become the Legal Aid Act. The Act, upon assent by the President shall establish a robust mechanism for coordination and regulation of legal aid in the country, formally recognize Paralegals and set standards for Legal Aid Provision. The Legal Aid Secretariat takes this opportunity to thank each institution, individual and stakeholder who took part in this long quest in the enactment of this Act. Sekretariati ya Msaada wa Kisheria inapenda kuujulisha Umma wa Watanzania kuwa Juma la Msaada wa Kisheria 2016 litaanza tarehe 1 Disemba 2016. Kwa mwaka huu juma la msaada wa kisheria linabeba dhima inayosema “Mfumo wa Kisheria kwa Msaada wa Kisheria Endelevu”. Dhima hii ni kutambua uratibu na usimamizi wa watoa msaada wa kisheria kwa ujumla chini Sheria ya Huduma ya Msaada wa Kisheria inayotegemewa kujadiliwa na Bunge la Jamhuri ya Tanzania hivi karibuni baada ya kusomwa kwa mara ya kwanza katika Mkutano wa Tano Kikao cha Tisa Mwanzoni mwa mwezi wa Novemba. Dhima hii ni wito pia kwa watoa msaada waote kujitayarisha kwa mfumo endelevu wa usimamizi na kuongeza zaidi ufanisi wa huduma ya Msaada wa Kisheria nchini

BREAKING NEWS: The Minister of Constitutional and Legal Affairs Hon Harrison Mwakyembe today held a Press Conference with Media Houses at the Ministry of Constitutional and Legal Affairs Conference Room in which among other things the Incumbent Minister was vocal on the Legal Aid Bill which was read for the first time by the Parliament in Early November 2016. Together with this, he also stressed on the importance of the public participation when the Parliamentary Committee will be welcoming comments on the Bill. He was flanked by the Assistant Director for Legal Aid at the Ministry of Constitutional and Legal Affairs Ms. Felistas Mushi and the Coordinator of the Legal Aid Secretariat Mr. Daniel Lema who also had the opportunity to enlighten the public on the status of Legal Aid services and coordination in the country.

Katika Mkutano wake wa Tano, Kikao cha Tisa, Bunge la Jamhuri ya Muungano wa Tanzania pamoja na shughuli nyingine za siku hiyo lilisoma kwa Mara ya Kwanza Muswaada wa Sheria ya Msaada wa Kisheria (The Legal Aid Bill).

Hii ni taarifa njema sana kwa wadau wote wa msaada wa kisheria nchini kwakuwa swala hili limekuwa ni kilio cha muda mrefu. Sheria hii inayolenga kusimamia na kuratibu utoaji wa msaada wa kisheria kwa watu wasiokuwa na uwezo, kuwatambua wasaidizi wa kisheria (Paralegals), Kufuta Sheria ya Msaada wa Kisheria (katika Masahuri ya Jinai) na kuweka mashari mengine ynayohusiana na hayo.

Kamati ya Bunge ya Mambo ya Katiba na Sheria itakuwa na kipindi kifupi cha maoni ya wadau mbalimbali kabla ya kuurudisha Muswaada huu Bungeni kwaajili ya Kusomwa mara ya pili na ya tatu. Ni wito wetu kuwa wadau wote wachukue fursa hii kuusoma vizuri muswaada huu ili waweze kutoa maoni pale Kamati husika ya Bunge itakapoitisha maoni.

LEGAL AID LEGISLATION SOON TO BE TABLED BEFORE THE PARLIAMENT

The Incumbent Minister of Constitutional and Legal Affairs has reiterated to the Public the Government's desire to put in place a comprehensive mechanism on Legal Aid in the Country.

Speaking to the press, the Incumbent Minister said that, the Fifth Phase Government is keen to ensure that equitable Access to Justice becomes a reality to all citizens especially the marginalized people in the community.

The incumbent Minister of Constitutional and Legal Affairs hosted a brief working meeting with members of the Legal Aid Secretariat Steering Committee and Staff to discuss among others, what LAS has been doing since its establishment and future prospects as well as the Impending Legal Aid Legislation in the offing. LANDMARK JUDGEMENT ON UNCONSTITUTIONALITY OF SECTION 13 and 17 of the LAW OF MARRIAGE ACT [CAP 29 R.E. 2002]

THE HIGH COURT OF TANZANIA has recently ruled out the provisions of Section(s) 13 and 17 of the LAW OF MARRIAGE ACT [CAP 29 R.E. 2002] as unfavorable to the girl child. Further to this and under the powers vested to it under Article 30(5) and Section 13 (2) of the Basic Rights and Duties Enforcement Act have directed the Government through the Attorney General to correct the complained anomalies in Section 13 and 17 of the Law of Marriage Act respectively and in lieu thereof put 18 years as the eligible age of Marriage for both Girls and Boys

Last week Saturday 11th June, 2016, LAS hosted Legal Aid seminar for the Parliamentary Standing Committee on Constitutional and Legal Affairs discussing mainly the provision of Legal Aid in Tanzania.Seminar was facilitated by Prof.Gastorn Kennedy who Presented on the " Overview and Evolution of Legal Aid in Tanzania" and Mr Sungusia Harold who presented on the topic of "Legal Aid in Practice".Seminar was preceeded by the opening speech made by Deputy Permanent Secretary Ministry of Constitutional and Legal Affairs (MoCLA).This event was both succesful and fruitful
