取得商標,就一定能搶回同名網域嗎?

WIPO 仲裁小組近日就「creditgpt.com」網域名稱爭議作出裁決,駁回申訴人的網域移轉請求,並進一步認定本案構成反向網域名稱劫持(Reverse Domain Name Hijacking, RDNH)。

本案中,申訴人主張其享有「CREDITGPT」商標權,因此依統一網域名稱爭議解決政策(Uniform Domain Name Dispute Resolution Policy, UDRP)請求將creditgpt.com網域移轉給自己。

另一方面,被申訴人係合法購買creditgpt.com網域名稱,並實際將其用於 AI 信用文件分析服務,提出包括公司設立、產品開發及實際營運等相關證據,主張其對該網域具有合法利益。

然而,依 UDRP,申訴人必須同時證明三項法定要件,三項要件缺一不可:
1.網域名稱與其商標相同或混淆性近似。
2.被申訴人對該網域不具有權利或合法利益。
3.該網域係以惡意註冊並使用。

仲裁小組認為,本案中申訴人未能證明其已具備UDRP所要求的商標權基礎,也未能證明被申訴人欠缺合法利益或具有惡意註冊、使用網域,因此駁回申訴。進一步審酌個案事實後,仲裁小組並認定本案已構成反向網域名稱劫持(RDNH)。

❗本案提醒品牌經營者❗
⭐商標權與網域名稱分屬不同的規範體系,商標權也不當然表示有權主張相同或近似的網域名稱。若要透過網域名稱爭議程序請求移轉網域,仍須依法證明 UDRP 的三項法定要件。

⭐因此,在品牌建立初期,建議同步規劃商標申請與網域名稱布局,以降低日後品牌推廣及維權成本。若發生網域名稱爭議,也應先審慎評估個案事實及相關證據是否符合爭議處理機制的法定要件,再決定是否提出申訴。

Recently, a WIPO Panel issued its decision in the “creditgpt.com” domain name dispute, denying the complainant's request to transfer the disputed domain name and further finding that the complaint constituted Reverse Domain Name Hijacking (RDNH).

In this case, the complainant claimed trademark rights in “CREDITGPT” and sought the transfer of the “creditgpt.com” domain name under the Uniform Domain Name Dispute Resolution Policy (UDRP).

On the other hand, the respondent had lawfully acquired the “creditgpt.com” domain name and was actively using it for an AI-powered credit document analysis service. The respondent submitted evidence, including company formation, product development, and actual business operations, to support its claim that it had rights or legitimate interests in the disputed domain name.

However, under the UDRP, the complainant must establish all three of the following legal requirements, and all three requirements must be satisfied:

1. The disputed domain name is identical or confusingly similar to a trademark in which the complainant has rights.
2. The respondent has no rights or legitimate interests in the disputed domain name.
3. The disputed domain name has been registered and is being used in bad faith.

The Panel found that the complainant failed to establish the trademark rights required under the UDRP and also failed to prove that the respondent lacked rights or legitimate interests in the disputed domain name or had registered and used the domain name in bad faith. Accordingly, the complaint was denied. After further considering the facts of the case, the Panel also found that the complaint constituted Reverse Domain Name Hijacking (RDNH).

❗Key Takeaways for Brand Owners❗

⭐Trademark rights and domain names are governed by different legal frameworks. Trademark rights do not automatically give the trademark owner the right to claim a corresponding or confusingly similar domain name. If a party seeks the transfer of a domain name through a domain name dispute proceeding, it must still establish all three legal requirements under the UDRP.

⭐Therefore, businesses are advised to develop their trademark and domain name strategies simultaneously at the early stages of brand development to reduce future branding risks and enforcement costs. If a domain name dispute arises, they should carefully evaluate whether the relevant facts and available evidence satisfy the legal requirements of the applicable dispute resolution mechanism before deciding whether to file a complaint.

近日,中國法院認定茶飲品牌「茉莉奶白」使用的四瓣花圖樣,與法國精品巨頭路易威登(Louis Vuitton,簡稱LV)知名「Monogram Flower」商標構成近似,判決停止使用相關標誌,並賠償人民幣1,030萬元(約新台幣4867萬元)。

本案引發不少討論,有網友認為,四瓣花紋源於傳統建築與窗櫺常見的四瓣花與柿蒂紋等裝飾元素,不應被品牌獨占。然而,從商標法的角度來看,法院審查的重點並非圖案最早由誰創作,而是在於該標誌是否已依法取得商標權、具有識別商品或服務來源的功能,以及後續使用該標誌是否足以使相關消費者產生混淆誤認。

值得注意的是,判決指出,茉莉奶白曾於中國申請多件相似圖形商標,皆因近似LV商標而遭駁回,卻仍持續將該圖案使用於中國2000多家門市(統計至2026年5月)之店面招牌、包裝及宣傳品上,這也成為中國法院認定其具有侵權故意的重要因素之一。在商標實務中,若申請人於商標申請過程中,已因官方核駁理由知悉其商標與他人在先商標存在衝突,卻仍持續使用該標誌,該核駁事實即可能成為法院認定其具有侵權故意的重要考量。

Recently, a Chinese court ruled that the four-petal flower device used by the tea brand Molly Tea (茉莉奶白) is confusingly similar to the well-known "Monogram Flower" trademark of French luxury brand Louis Vuitton (LV). The court ordered the brand to cease using the disputed logo and awarded RMB 10.3 million (approximately TWD 48.67 million) in damages.

The ruling has sparked widespread discussion. Some commentators argue that the four-petal flower motif originates from decorative elements commonly found in traditional architecture and lattice window designs, including the four-petal floral pattern and the “shidi” (persimmon calyx) motif, and therefore should not be monopolized by a single brand. From a trademark law perspective, however, the court's focus is not on who first created the design. Instead, the key issues are whether the sign has been lawfully registered as a trademark, whether it functions as an indicator of the source of goods or services, and whether its subsequent use is likely to cause confusion among relevant consumers as to the origin of those goods or services.

Notably, the judgment pointed out that Molly Tea had previously filed several similar device trademark applications in China, all of which were refused because of their similarity to LV's trademark. Despite these refusals, the company continued to use the disputed design on storefront signage, product packaging, and promotional materials across more than 2,000 stores in China (as of May 2026). This was one of the key factors leading the court to conclude that the infringement was intentional. In trademark practice, if an applicant has been informed through an official office action that its mark conflicts with an earlier trademark, yet continues to use the mark, that refusal may become an important consideration for a court when determining whether the applicant acted with intent to infringe.

Trademark protection extends beyond creative design—it also safeguards the distinctiveness and goodwill that a brand has built over time. When developing a logo, businesses should look beyond aesthetics by conducting comprehensive trademark clearance searches and risk assessments, and by securing trademark registration as early as possible. Taking these steps can help prevent costly infringement disputes after substantial resources have already been invested in building and growing a brand.

近兩年來,全世界持續有更多的人投入匹克球運動,因此市場擴張、球具選擇也越趨多元。其中,JOOLA 是近年在美國市場快速擴張、並積極布局專利與職業選手合作的匹克球品牌,其於2026年4月7日向 United States International Trade Commission(ITC)提起訴訟,一口氣點名目前匹克球主流的11家球拍品牌,主張其「Propulsion Core」動能核心技術遭未授權使用。該技術核心在於蜂巢結構邊緣加入U型高密度泡棉,目的是在擊球瞬間產生類似蹦床的回彈效果,同時維持穩定控制。
而JOOLA選擇 ITC 也顯示其策略意圖,一旦勝訴可直接發布進口禁令,對多數仰賴海外代工的品牌將是重大打擊,且審理時間也遠快於一般法院。

Over the past two years, more people around the world have joined the sport of pickleball, driving rapid market expansion and an increasingly diverse range of equipment choices. Among the key players, JOOLA has emerged as a fast-growing brand in the U.S. market, actively investing in patent strategies and collaborations with professional athletes. On April 7, 2026, JOOLA filed a complaint with the United States International Trade Commission (ITC), naming 11 major pickleball paddle brands and alleging unauthorized use of its “Propulsion Core” technology. This technology centers on incorporating a U-shaped high-density foam along the edge of a honeycomb core, designed to create a trampoline-like rebound effect upon impact while maintaining stability and control.
JOOLA’s decision to bring the case before the ITC reflects a clear strategic move. If successful, the ITC may issue an exclusion order to block the importation of infringing products, which would pose a significant threat to brands that rely heavily on overseas manufacturing. In addition, ITC proceedings are typically much faster than those in federal courts.
Reactions within the pickleball community have been mixed. Some players are concerned that the case may lead to market consolidation or that the costs of developing original technologies and paying licensing fees could ultimately be passed on to consumers. Meanwhile, one of the accused brands, Friday Labs, responded humorously in a video, stating, “We’re happy to be among the top 11 brands,” while pickleball media platform Building Pickleball has voiced support for JOOLA’s efforts to enforce its rights, viewing it as a positive development for the industry. Overall, this dispute goes beyond a simple infringement issue and may have broader implications for pricing, innovation, and the competitive landscape of the pickleball equipment market.

2026 年世界盃足球賽開踢,全球球迷熱情沸騰,也帶動龐大的周邊商品商機。不過在賽事開幕前夕,香港海關採取代號「鋼門」的執法行動,偵破 34 宗相關案件,查獲欲銷售於海外地區約 23 萬件疑似仿冒商品,包括球衣、球鞋等,估計市值高達約港幣 1.56 億元(約新台幣 5.9 億元)。

FIFA 長期透過商標、官方授權制度及跨國執法合作,維護世界盃相關智慧財產權,除了打擊仿冒商品外,更將「埋伏行銷(Ambush Marketing)」列為品牌保護工作的重點之一。

所謂埋伏行銷,是指企業未取得官方贊助資格,卻透過廣告、促銷活動、社群貼文、抽獎贈票,甚至在球場周邊進行宣傳等方式,刻意營造與世界盃具有關聯的印象,藉此搭上賽事熱度獲取商業利益。這類行為可能削弱官方贊助商的權益,FIFA亦將埋伏行銷列為品牌保護及智慧財產權保護工作的重點。

隨著大型國際賽事帶來龐大流量,企業若想搭上熱潮並規劃推出世界盃相關行銷活動,也應特別留意商標及品牌使用規範,避免未經授權使用賽事名稱、官方標誌、獎盃圖樣或其他受保護元素,更應避免以任何方式使消費者誤認與 FIFA 或官方贊助商存在合作、授權或其他商業關係,以降低商標侵權及不公平競爭等法律風險。

⚽ FIFA's Intellectual Property Protection Efforts

As the 2026 FIFA World Cup kicks off, football fever is sweeping across the globe, driving tremendous demand for official merchandise. Just before the tournament began, Hong Kong Customs launched a special enforcement operation codenamed "Steel Gate," uncovering 34 cases involving approximately 230,000 suspected counterfeit products, including football jerseys and shoes, with an estimated market value of HKD 156 million (approximately TWD 590 million).

To safeguard the commercial value of the FIFA World Cup, FIFA has long relied on trademark protection, official licensing programs, and international enforcement cooperation to protect its intellectual property. Beyond combating counterfeit goods, FIFA also places significant emphasis on preventing “ambush marketing” as part of its brand protection strategy.

Ambush marketing refers to situations where businesses, without obtaining official sponsorship rights, attempt to create an unauthorized association with the World Cup through advertisements, promotional campaigns, social media posts, ticket giveaways, or marketing activities around event venues. Such practices may undermine the exclusive rights and commercial interests of official sponsors, making them a key focus of FIFA's IP enforcement efforts.

As major international sporting events generate enormous public attention, businesses planning World Cup-related marketing campaigns should carefully observe applicable trademark and branding guidelines. Unauthorized use of tournament names, official logos, trophy designs, or other protected elements should be avoided. Companies should also refrain from creating any impression that they are affiliated with, endorsed by, or officially connected to FIFA or its sponsors, thereby minimizing potential risks of trademark infringement and unfair competition.
