1976 doğumlu Bahaa’nın hikayesi 1999 tarihinde Türkiye’de Mit tarafından kaçırılması ile başlar. Zor olsa da ellerinden kaçmayı başarır. Ancak hayatta kalmak için Türkiye’yi terk etmek zorunda kalır. Ailesinin Suriye’yi 80 olaylarında terk etmesi sebebiyle ülkesine dönemeyen Bahaa Pakistan’ın başkenti İslamabad’a yerleşir ama uzun süre kalamaz. 11 eylül saldırılarından sonra Pakistan’ın kendi topraklarında Amerika ile ortaklaşa göz altı operasyonlarına başlayarak yabancıları sınır dışı etmesi üzerine , birçokları gibi Bahaa’da tutuklanarak Suriye’ye teslim edilir. Üstelik sorgusunda her hangi bir örgütle bağlantısı olmadığı anlaşılmasına rağmen. Suriye’ yi küçük yaşta terk ettiği için ülkesine ait bir geçmişi olmasada teslim edilir edilmez kendini tek kişilik hücrelerde bulan Bahaa ,tutukluğu esnasında kendisine uygulanan işkencelerin yanı sıra 2002- 2011 yılları arasında cezaevi içinde yapılan katliamın hayatta kalmayı başaran şahitlerinden biridir. Suriye’ de serbest bırakılmasının hemen ardından ailesinden ayrı geçirdiği yılları telafi etmek istercesine onların yanına gitti ancak büyürken göremediği çocuklarına doyamadan birkaç gün içinde Türk emniyeti tarafından tutuklandı. Bahaa’ya verilen 12 yıl hapis cezasının şaşkınlığı içinde olan Bahaa’nın ailesine göre mahkemenin elinde kayda değer bir delil olmaksızın Bahaa’nın terör örgütü kurmak ve yönetmek suçuyla cezalandırılması olayın içinde istihbaratın parmağının olduğu şüphesini güçlendirmekte. Mahkemenin elinde Baha’yı tanıyan yada sadece birkaç kere görüştüğü kişilerin işkence altında verdiği ifadelerden başka bir şey bulunmadığı gibi,(aynı şahıslar Baha’nın yurt dışında olduğu sürede yargılanıp hapis cezasına çarptırıldılar.) bilinen o ki tutuklular arasında adı geçen şahıslardan birinin daha önce verdiği ifadeleri işkence altında alındığı gerekçesi ile mahkeme heyeti önünde yalanlamış olmasına rağmen bu ifadeler Bahaa aleyhine delil olarak kullanıldı. Mahkeme , adı geçen şahidin işkence altında alınan ve gerçekleri yansıtmayan ifadesini geri çekmek istemesi yönündeki açıklamalarını kabul etmemiş üstelik savunma avukatının ifadelerdeki çelişkilerin giderilmesi ve davanın aydınlatılmasını sağlayacak olan şahitlerin
tekrar dinlenmesi yönündeki talebini de reddederek eksik savunma üzerine kararını vermiştir. Bizler Bahaa’nın arkadaşları olarak bu sayfayı adaletin yerini bulması ve Baha’nın özgürlüğüne kavuşması amacı ile hazırladık. This page has been set up in support of Bahaa Joughel who was sentenced to 12 years in prison based on statements procured through torture and in absence of any concrete piece of evidence. Our case is that of a wronged Syrian man (of Turkish origin) married to a Turkish lady and father of two children, a family whose members were torn apart by tyranny that placed him in one prison after another and set the scene once again for another chapter of hardships in which he moves from Syria’s prisons to Turkey’s jails where he gets sentenced to twelve and a half years of imprisonment. Bahaa’s story started in Turkey where he was abducted by the MIT intelligence organization in 1999 (two months after his wedding) and was asked - under torture - to commit terrorist acts. He refused and managed to slip through its fingers with great difficulty, but was subsequently left with no option but to leave the country and seek help. Considering Pakistan the only alternative (his family had left Syria during the eighties), Bahaa moved to and settled in Islamabad, his stay cut short by the American and Pakistani authorities that were, in the wake of the September 11 attacks, cracking down on and deporting the foreigners in Pakistan. Bahaa was among those who were arrested and later extradited to Syria despite the fact that the investigations established beyond doubt that he was not a member of any organization. Even though Bahaa had virtually no history in Syria; he had left the country barely a child of five, he found himself overnight in its solitary cells and abject jails sipping the cup of suffering and torture and witnessing firsthand the horrific massacres that stretched between the years 2002 and 2011. On being released, Bahaa proceeded to Turkey in 2012 with deep longing for the family that was deprived of him for long years but was, in a matter of numbered days, arrested by the Turkish authorities to return once again to a life of ordeal. Bahaa and his family were shocked by the miscreant decision to sentence him to twelve and a half years in prison on charges of setting up an illegal organization and planning out terrorist acts. It was evident that the decision was imposed by the MIT Intelligence Organization since the court had no legal basis for its judgment save for false confessions extracted under torture from several of Bahaa’s acquaintances and from people he had met no more than once or twice in his life (they were imprisoned during Bahaa’s time abroad) and keeping in mind that one of the former denied his earlier statements and exposed the torture that he was made to endure in order to extract the confessions that implicated Bahaa. The court not only blatantly disregarded the denial of the witness to his previous statements and his assertion that they were taken under torture but also refused to summon the rest of the witnesses to court in spite of a request by the defense to have them questioned again. It went forward in announcing its unjust sentence. We- a group of Bahaa’s friends- set up this page to support his case, in an effort to secure him the justice that he has been deprived of and in hope that you will lend a hand to achieve this goal.
