Beware of financial scams in Thailand

Scammers are getting more advanced and aggressive with their scams, and most of people don’t know how to protect themselves.
A financial fraud can be devastating for a victim, whether a scammer gets access to your bank card numbers or convinces you to invest in a fraudulent scheme.
There are many types of financial scams, but almost every scam is based on one of the following types of fraud.

1- Ponzi scam
Scammers get you put money into an investment that is not real.
They often lure victims with promises of large gains and little risk.
In many cases, investment schemes target affinity groups to build trust then the scammers disappear with your money.

2- Phishing attack
Criminals have a few options to success stealing your sensitive information.
They might target you with a phishing attack where they email, call, or text pretending to be from your bank. Or, they could target you with a cyber-attack to get you to install malware on your devices that steals your logins and passwords.

3- Advance fee fraud
This fraud happens when a fraudster requires you to send money in advance for payments, products or services. But in the end, the promised rewards never arrive.
A common example is when a scammer claiming to get you a loan and ask you to pay the fees in advance for introducing you to the financing source.
But after you pay, you will often discover that you are ineligible for the loan and that you lost the advance fees.

4- Fraudulent charity
Some scammers use philanthropy as fraud.
Charity fraud involves creating a fake charity and collecting donations that disappear along with the scammer.
These scams are especially common during natural disasters or international news events.

5- Credit card fraud
There are several ways that criminals can steal your credit card information.
They could steal your physical card, trick you into entering information on a phishing website or email, buy your details on the Dark Web.
Hackers can also create a clone of your physical card using just your credit card numbers.

6- Romance scam
Romance scams occur when a criminal adopts a fake online identity to gain affection and trust from the victim.
The scammer uses the illusion of a romantic or close relationship to manipulate and steal money from the victim.
The scammer’s intention is to establish a relationship as quickly as possible and gain trust.
Scammers may propose marriage and make plans to meet in person, but that will never happen and they will get a maximum money from the victim.

BASIC RECOMMENDATIONS
- Be careful what you post and make public online. Scammers can use details shared on social media and dating sites to better understand and target you.
- Research the person’s photo and profile using online searches to see if the image, name, or details have been used elsewhere.
- In any business negotiation, go slowly and ask lots of questions.
- Beware if the individual seems too perfect or quickly asks you to leave a dating service or social media site to communicate directly.
- Beware if the individual attempts to isolate you from friends and family or requests inappropriate photos or financial information that could later be used to extort you.
- Beware if the individual promises to meet in person but then always comes up with an excuse why he or she can’t. If you haven’t met the person after a few months, for whatever reason, you have good reason to be suspicious.
- Never send money to anyone you have only communicated with online or by phone.
- Beware if someone you meet online needs your bank account information to deposit money, they are most likely using your account as mule account to carry out other fraudsters and fraud schemes.

Overstay visa in Thailand

An overstay situation is when a foreigner is on Thai territory for a period exceeding the authorized duration by their visa or entry stamp.

It is the responsibility of the foreigner to ensure that they do not exceed their authorized stay.

Every year, many foreigners in Thailand find themselves in overstay, sometimes unintentionally such as misunderstanding about the visa expiration date, or quite frequently due to visa agencies failing to do their job.

When the foreigner realizes that his visa has expired, he must solve the problem as soon as possible, even if it is just one day, because overstay is considered illegal in Thailand and presents a high risk of imprisonment.

If a foreigner stays in Thailand without renewing or extending their Thai visa, they will find themselves in overstay and will have to pay a fine of 500 baht per day with a maximum of 20 000 baht.

Additionally, if a foreigner is arrested while exceeding the period of visa, or if the overstay exceeds 90 days, he will be deported and will no longer be allowed to enter Thailand during a specified period.

The duration of the ban depends on the period of overstay, and whether the foreigner surrenders himself to the Thai authorities or if he got arrested:

Duration of territory ban

- If the foreigner surrenders himself to the Thai authorities:
Overstay of more than 90 days: 1 year ban
Overstay of more than 1 year: 3 years ban
Overstay for more than 3 years: 5 years ban
Overstay for more than 5 years: 10 years ban

- If the foreigner is arrested and sentenced by the Thai authorities:
Overstay of less than 1 year: 5 years ban
Overstay of more than 1 year: 10 years ban

Visa controls are frequent in Thailand.
Immigration police randomly check foreigners staying at entertainment venues, on the streets, at popular tourist spots, at companies that hire foreigners to work, and at roadside checkpoints.
There is even a risk to detect an overstay during check-in in a hotel or during a medical visit at hospital.

Therefore, to avoid the risk of being arrested, it's important not to exceed the period of visa, and to choose a professional visa agency to take care your visa.

The Cannabis business in Thailand

Since June 9th, 2022, Thailand has become the first Asian country to legalize Cannabis.
Anyone over the age of 20 (except pregnant or breastfeeding women) is authorized to consume Cannabis in their residence or inside a commercial establishment with a Cannabis license.
Cannabis smoke is considered a public nuisance and is therefore prohibited in public spaces.
Possession, cultivation, consumption and sale of all parts of the cannabis plant are legal.
On the other hand, cannabis extracts and cannabis products containing more than 0.2% THC are still classified as narcotics.

Inspired by the Californian model, Thailand understood that the cannabis market was a real economic opportunity.
The legalization of Cannabis was carried out under the leadership of the former Minister of Health and under the current Government Deputy Prime Minister and Minister of the Interior, Mr. Anutin Charnvirakul, whose objective was to stimulate the sectors of the agriculture and tourism in Thailand.
So far, more than 5,000 Cannabis licenses have been issued in Thailand and Cannabis businesses have multiplied (1,330 stores in Bangkok, 555 stores in Pattaya, 520 stores in Phuket).

Driving license in Thailand

To drive legally in Thailand, it is necessary to have a driving license.
There are two possibilities depending on the type of stay.

Regarding driving a car:
- For a stay of less than 60 days with a tourist visa, it is possible to drive with a driving license from the original country and with an international driving license
- For a stay of more than 3 months with another visa, a Thai car driving license is required for driving in Thailand

Regarding driving a motorbike, there is no distinction in engine capacity in Thailand, but a motorcycle license is necessary:
- For a stay of less than 60 days with a tourist visa, it is possible to drive with a motorbike license and an international driving license mentioning option motorbike
- For a stay of more than 3 months with another visa, a Thai motorbike driving license is required

To obtain a Thai driving license for expats, there are two options:
- Option 1: Already hold a license from the country of origin
In this case, obtaining a Thai driving license is quite simple and quick, because you just need to fill out a file and pass two quick tests (eye test and reaction time test).
- Option 2: Not holding a license from the country of origin
In this case, it is preferable but optional to take driving lessons at a driving school in Thailand. Then, you will have to pass a theory test and a driving test to be able to obtain the Thai driving license.

PREPARING A WILL IN THAILAND

Preparing a will in Thailand must follow a certain format, otherwise the will is not effective.
A will can be drafted by a lawyer, a legal professional or an individual, but the will must ensure it meets the following legal requirements.

1- The will must be written in Thai language.
2- The testator must sign the Will in the presence of two witnesses who must also sign the will.
3- The witnesses must be at least 20 years old and have the capacity to understand the will’s contents.
4- The testator must have the mental capacity to make a will and must not have been unduly influenced by others.
5- The will must not contain any provisions that are contrary to Thai law.
6- The will must be dated and include a clear statement of the testator’s intentions regarding the distribution of their assets.

Making a will in Thailand makes it much easier for successors to claim the assets of the lost relative. Without a will, the process can be long and can make the successors give-up to claim the assets, particularly if they are living outside Thailand.
