Isaan Lawyers, have since 2007 been assisting expats and overseas nationals with property purchases and protection nationwide.
At Isaan Lawyers, we provide sophisticated and robust legal services to facilitate your property endeavors throughout Thailand, with a particular focus on the Isaan region. Whether your interest lies in urban condominiums, serene villas, private residences, or expansive land parcels, our expertise ensures a secure and streamlined process. Our Property Legal Solutions are meticulously structured to protect your investment at every stage.
Safeguarding Your Real Estate Ventures Across Thailand
We advise clients across the nation, managing property transactions from more modest acquisitions to high-value luxury estates. Acknowledging the inherent variations in risk associated with different property types, we tailor our approach. A simple condominium purchase, for instance, typically requires a different scope of due diligence compared to a high-value villa or a complex land transfer. Our property solutions are therefore adaptable, scalable, and customized to align precisely with your unique situation.
With Isaan Lawyers, you can confidently navigate the complexities of real estate transactions in Thailand, underpinned by our profound understanding of the Civil and Commercial Code and the Land Code.
Components of Our Property Legal Solutions
Our fee structures for property services generally commence from 19,750 THB, subject to adjustment based on the intricacy of the transaction and the depth of protective measures required. Our comprehensive services may encompass the following work and packages:
• Deed Verification: We conduct diligent verification of the property's title deed at the designated Land Department office. This includes obtaining official certifications confirming the document's authenticity, issuance date, and the validating officer's signature. This adheres to the legal requirement for registration of real rights over immovable property, as stipulated in Section 1299 of the Civil and Commercial Code.
• Encumbrance and Ownership Due Diligence: Our legal team meticulously confirms the legal proprietor of the property, verifies boundary demarcations as recorded in the title instrument, and identifies any existing mortgages, charges, or other legal burdens that might impact your interest, consistent with the framework of property rights defined in Book IV of the Civil and Commercial Code.
• Agreement Scrutiny and Counsel: We undertake a comprehensive review of the Sale and Purchase Agreement, reservation agreements, and all supporting documentation. This involves a detailed examination of clauses pertaining to deposits, refunds, timelines, and other critical contractual provisions, ensuring your rights and obligations are explicitly defined and safeguarded under the Civil and Commercial Code, particularly sections governing contracts of sale and hire of property (e.g., Sections 453-571).
• Multilingual Advisory Services (English, Thai & Vietnamese): You will benefit from direct engagement with our experienced legal professionals, including qualified Thai lawyers and notaries. We ensure transparent communication throughout your engagement and can provide explanations in Thai to your spouse, family members, or designated agent via telephone or email, as necessary.
• Foreigner Investment Protections: Recognizing the legal framework restricting foreign ownership of land under the Land Code Act B.E. 2497 (1954) (specifically Section 86), we specialize in structuring agreements to protect your interests. If the property is fully paid for, we can draft and register various agreements, including:
o Usufruct Arrangements: Pursuant to Sections 1417-1428 of the Civil and Commercial Code, a usufruct grants the beneficiary the right to possess, use, and enjoy another's property and its fruits. This serves as a vital instrument for foreign nationals unable to directly own land, enabling them to benefit from the property for a defined period or for the beneficiary's lifetime.
o Long-Term Lease Agreements: Foreigners are permitted to lease land for up to 30 years, with potential for renewal, as set forth in Sections 537-571 of the Civil and Commercial Code concerning the hire of immovable property. We ensure these leases are properly formulated and registered with the Land Department to be legally enforceable against third parties.
o Superficies Rights: Governed by Sections 1410-1416 of the Civil and Commercial Code, a superficies allows an individual to own structures or plantations situated on another person's land. This legal concept facilitates separate ownership of the building from the land, offering a robust form of protection for foreign real estate investors.
o Sap Ing Sith: This newer property right, introduced by the Sap-Ing-Sith Act B.E. 2562 (2019), grants the holder the right to use and benefit from immovable property, including land with a Chanote, buildings on such land, and condominium units. It can be registered for up to 30 years with the possibility of renewal, and importantly, can be transferred and used as security for a mortgage, offering enhanced control and financial security compared to traditional leases.
o Partnership Memoranda: We can also prepare Memoranda of Understanding (MOUs) between partners or family members to clarify beneficial ownership and financial contributions, adding a layer of transparency and security.
o Loan and Mortgage Agreements (where no existing bank mortgages are outstanding): In situations where there are no existing bank mortgages on the property, we can assist in drafting and registering private loan and mortgage agreements to secure your investment. This ensures that the terms of the loan, the mortgaged property, and the maximum secured amount are clearly defined and registered in accordance with Sections 702-714 of the Civil and Commercial Code, providing a legally enforceable claim against the property. Our team will meticulously prepare all required documentation and offer clear, step-by-step guidance on applicable taxes and registration fees payable to the Land Office.
• Last Will and Testament Preparation: Should alternative property protection strategies not align with your objectives, we can prepare a comprehensive Last Will and Testament in both Thai and English, facilitating the secure disposition of your assets in Thailand in accordance with the provisions of the Civil and Commercial Code pertaining to succession and wills (e.g., Sections 1620-1675).
• Vendor and Developer Liaison: We manage all direct communications with sellers, agents, or developers to ensure clarity on contractual terms, payment conditions, and any adjustments to the acquisition timeline.
