⚖️ Choosing the Wrong Lawyer Can Ruin Your Life! A Basic Guide Before Hiring a Lawyer in Thailand ⚖️
When legal trouble arises, many expats and tourists often ask: "How do I choose a reliable lawyer?" and "How should I prepare?"
Choosing the wrong lawyer can turn a stressful situation into an absolute nightmare! Today, our law office has prepared a basic checklist for your first legal consultation.
1️⃣ Always Ask to See Their "Lawyer License" (Attorney Card) 🪪
In Thailand, practicing lawyers must be licensed by the Lawyers Council of Thailand. This guarantees they have passed the required legal and ethical examinations.
⚠️ Warning: Beware of Fake Lawyers & Imposter Law Firms
🚨 Unlicensed Practitioners: Anyone practicing law, drafting lawsuits, or representing clients without a valid license faces up to 2 years in prison and/or a fine of up to 40,000 Baht under the Lawyers Act B.E. 2528.
🚨 Imposter Law Firms: Some firms operate for decades under owners who look professional and sound convincing but are NOT actual lawyers. If they abandon your case, the Lawyers Council cannot discipline them due to legal loopholes.
🚨 Suspended or Disbarred Lawyers: If a lawyer whose license is suspended (up to 3 years) or revoked still proceeds with your case in court, the entire court proceeding will be deemed invalid! This will cause catastrophic damage to your case.
2️⃣ Check for "Conflict of Interest" 🤝
Before signing a contract, ask the lawyer directly: "Do you have any personal relationship, connection, or shared interest with the opposing party?"
🤝 If a lawyer is closely connected to, acts as an advisor for, or has a financial interest in the opposing party's assets, they cannot fully protect your rights.
🤝 Accepting information from one party and later working for the opponent is a severe violation of client confidentiality and professional ethics.
3️⃣ Clarify "Legal Fees and Case Expenses" Transparently 💰
Different lawyers have different billing methods (flat rate for all 3 courts, per-court basis, or hourly rates). Here is what you need to know:
💵 Court Fees (Civil Cases): The official court fee is generally 2% of the claimed amount (capped at 200,000 Baht). For non-monetary claims, the fee is 200 Baht, plus minor petition fees. Criminal cases generally do not require court fees.
🛑 Beware of Overcharging Scams: Watch out for dishonest practices where an operator falsely claims court fees are 3% or 5% just to pocket the difference.
🛑 Beware of Excessive Fees: Legal fees should be reasonable and proportionate to the case, not an act of extortion when a client is in desperate need of help.
📝 5 Key Steps When Retaining a Lawyer
Hand Over Evidence with a Record: Write down a detailed statement of facts, list your witnesses, and have the lawyer sign an acknowledgment of received documents.
Sign a Written Legal Service Contract: Ensure the contract is detailed and accurately reflects your verbal agreement. Clarify any ambiguous terms before signing.
Keep an Organized Copy of All Files: Always keep copies of every document you submit, including all correspondence between you and your lawyer.
Follow Up on Your Case Closely: Stay updated on your case. Ultimately, the legal outcome directly impacts you, so do not leave everything entirely unmonitored.
Remember Court Dates Strictly: Forgetting or failing to appear on a scheduled court date can cause severe, irreversible damage to your lawsuit.
