🧠⚖️ Thailand's First Draft AI Act: A New Standard for Responsible Innovation

Thailand's Digital Economy and Society Minister recently confirmed that the country's first Artificial Intelligence Act is on track to be finalised within this fiscal year.

The announcement was made at AI Governance Week 2026, held from 29 June to 3 July, hosted by the Electronic Transactions Development Agency (ETDA) and its AI Governance Center (AIGC).

The law is being drafted with a clear purpose in mind. On one side, it aims to support the continued growth and adoption of AI. On the other hand, it seeks to protect public interest, individual rights, and safety, particularly where AI systems carry high risk.

✅ What we know so far:
➜ The draft law follows a risk-based approach, with prohibited AI systems banned outright, and the strictest oversight applied to high-risk AI systems.
➜ The draft includes administrative penalties, with fines potentially reaching up to THB 5 million depending on the violation.
➜ Foreign providers may be required to appoint a local representative or authorised coordinator in Thailand.
➜ Certain AI-generated content, including deepfakes and content relating to sensitive public interest matters, may be subject to transparency and labelling requirements.

The government has framed the law as part of a broader goal to position Thailand as a regional hub for AI governance, alongside efforts already underway through the AI Governance Centre and updated guidelines for state agencies.

The draft remains under consultation and may be further revised before it enters the legislative process.

Wer schon einmal ein Non-B- oder Non-O-A-Visum verlängert hat, kennt den Bürokratie-Marathon: Notar, Botschaft, Beglaubigung durch das Außenministerium (MFA) – ein zeitraubender und teurer Prozess.

Damit ist jetzt Schluss (oder zumindest wird es deutlich einfacher)!

Mit dem neuen Erlass des Immigration Bureau (No. 122/2026) akzeptiert Thailand für bestimmte Dokumente ab sofort die Apostille als Alternative. Das spart Expats, Pensionären und Unternehmen eine Menge Papierkram und Aufwand bei der Vorbereitung.

✅ Das Wichtigste auf einen Blick:
➜ Die Voraussetzungen für das Visum bleiben unverändert.
➜ Nur die Beschaffung der Unterlagen wird erheblich vereinfacht.
➜ Gilt rückwirkend seit dem 28. Mai 2026.

🇹🇭🗂️ Good News! What Changed in Thailand's Renewal Process

Renewing a Non B or Non O A visa in Thailand could require multiple layers of document authentication, including notarisation, embassy legalisation and certification by the Ministry of Foreign Affairs for certain foreign documents.

That has changed.

Under Immigration Bureau Order No. 122/2026, Thailand will now accept the Apostille as an alternative for certain supporting documents in specific visa extension categories. This saves expats, retirees, and companies a lot of paperwork and effort in preparing their documents.

The amendment may also simplify document preparation for organisations that previously faced challenges obtaining certain supporting documents.

Eligibility rules stay the same. Only the paperwork gets simpler.

Effective retroactively as of May 28, 2026.

📢❗New BOI Announcement Changes Quarterly Reporting Requirements

Thailand's BOI has tightened its compliance clock. Under Announcement No. Por. 8/2569, BOI-promoted companies with projects that have not yet commenced operations must now file progress reports every quarter, within 30 days of quarter-end, down from the previous 60-day window.

🗓️ The standard reporting schedule is:
Q1: January to March
Filing deadline: 30 April

Q2: April to June
Filing deadline: 30 July

Q3: July to September
Filing deadline: 30 October

Q4: October to December
Filing deadline: 30 January of the following year

Still working off the old February/July cycle? That rule no longer applies.

Miss a filing, and access to BOI rights and privileges may be temporarily suspended until the report is submitted. Miss two consecutive filings, and the BOI may revoke your promotional rights and privileges.

If your company holds a BOI promotion certificate, now is the time to review its conditions, confirm your current reporting cycle, and make sure your e-Monitoring submission process is ready before each deadline.

✈️ 💳 Thailand's New Visa Rules: One Country, One Entitlement

Thailand has just revised its visa framework, affecting visa privileges for 65 countries and territories.

The old 60-day visa exemption for 93 countries and territories has been withdrawn.

Under the new policy, 59 countries, including EU states, now receive 30-day visa-free entry. Other countries and territories receive adjusted entitlements, ranging from 15-day visa-free entry to Visa on Arrival, alongside tighter screening via an upgraded Thailand Digital Arrival Card (TDAC).

The goal is not to limit tourism but to close loopholes under a "one country, one entitlement" policy. New rules take effect 15 days after publication in the Royal Gazette, and the implementation details may still be refined before then.

Foreign nationals currently in Thailand can continue under their existing permitted period of stay.

Achtung bei Investitionen in Thailand: Das Handelsministerium reformiert den Foreign Business Act. Neun Sektoren fallen aus der direkten Regulierung des Ausländergesetzes.

Was nach Erleichterung klingt, ist für ausländische Investoren oft eine bürokratische Verschiebung. Die Genehmigungspflichten wandern lediglich zu den jeweiligen Fachaufsichten wie der Bank of Thailand oder der SEC.

Gleichzeitig verschärfen die thailändischen Behörden die Kontrollen bei der Firmengründung.

✅ Das klare Ziel: Illegale Strohmann-Konstruktionen (Nominees) werden konsequent aufgedeckt und sanktioniert.
