New Customs Regulations Implemented by Thai Customs Department Effective July 29, 2022

After multiple rounds of internal discussions, dialogues with IP experts and legal practitioners, the Thai Customs Department officially issued the new regulations that were being keenly awaited by registered IP owners. The Notification of the Customs Department No.106 / 2565 (2022) Re: Control of Export, Import and Transit of Trademark and Copyright Infringing Goods was issued by the Thai Customs Department and became effective on July 29, 2022. This notification repeals in its entirety, and replaces any prior notification(s) of the Customs Department governing any arrangements relating to trademark and copyright infringing goods.

Pursuant to the new regulations, IP owners need to re-record all their registered trademarks or copyright with the Thai Customs Department directly. Though it is not obligatory for the IP owners to do such recordation, it is strongly recommended, to ensure a better protection against fake goods.

Application Procedure:

Recordation of a trademark or copyright with the Thai Customs Department can be done via the online system that is currently being developed by the Customs Department and is expected to be officially launched for the public in September 2022.

Validity of Period of Customs Recordation:

The information under the recordal application shall be valid for three (3) years from the date of receipt of the application or for the remaining period of protection of such trademark or copyright pursuant to the trademark or copyright law, whichever is earlier.

An extension of the validity period of such information may be requested by submitting an application of extension of time with the Enforcement Division, Customs Department, not less than 30 days prior to expiration, and upon submission of the application for extension of time, the information shall remain valid for another three (3) years.

In a major update which will be pleasing for trademark applicants interested in obtaining protection for their brands in Thailand, the Department of Intellectual Property (DIP) has announced the new Trademark Examination Guidelines, which shall be used going forward, to examine distinctiveness of the marks by the Trademark Registrars. The guidelines became effective January 17, 2022 and shall apply to the examination of pending trademark applications which have not been examined yet as well as new applications to be filed in the future.

The published examination guidelines have brought significant clarity on the distinctiveness of several types of trademarks, many of which earlier heavily depended on the individual discretion of the examining Registrars and consequently, often faced refusals, despite court precedents allowing registration of such marks.

The examination guidelines are expected to be uniformly followed by all Registrars while examining the applications. For further details on the examination guidelines regarding examination of trademarks and general IP matters, please contact us at [email protected].

Exciting news for genuine rights owners in Thailand! The Department of Intellectual Property (DIP) has, effective March 1, 2021, implemented Fast Track Trademark Renewals for straight forward renewals.

The key points are:
1. The total number of goods and services for the mark must not exceed 30 items
2. No changes can be made, ie) change of name or address, reclassification of goods etc. will render the mark ineligible for fast tracking
3. The renewal application must be filed in person at the DIP by the trademark owner or a duly appointed attorney
4. Fast Track examination must be requested at the time of filing the renewal
5. There is no additional cost
6. The internally mandated turnaround time is to issue the Renewal Certificate in 45 minutes

That is not a typo, they have committed to a 45-minute turnaround time, which is an absolutely massive reduction from the 3-6 months it took previously to receive a renewal certificate.

Another step in the right direction by the Department of Intellectual Property in their continuing mandate to make Thailand a safe haven for IP owners through improvement of the IP legal framework and greater efficiency in the relevant IP Offices.

Thailand Draft Amended Patent Act: Impact on Pharmaceutical / Medical Inventions

The current Thai Patent Act first came into force on September 12, 1979 (B.E. 2522). It has been amended several times over the years, with the latest amendments carried out in 1999. Amendment is required due to the advancement of technology, emergence of new technologies and also to improve efficiencies in the handling of the increasing number of patent applications. The Thai Patent Act B.E. 2522 is once again undergoing a major revision. The draft amendments underwent a second public hearing in late 2020.

The new draft Patent Act introduces various changes to procedures relating to the filing and prosecution of patent and petty patent applications in Thailand.
