Operating a tourism business in Thailand without a valid license is a criminal offense. As the Department of Tourism and Tourist Police intensify inspections—targeting both physical agencies and digital platforms—compliance has become a critical priority for investors and operators.

Under the Tourism Business and Guide Act, "tourism activity" is broadly interpreted. Whether you are an inbound operator, a domestic travel coordinator, or a digital experience platform, you must secure a license which requires:
▪️Thai Majority Structure: At least 51% Thai shareholding and 50% Thai directors.
▪️Security Deposits: Cash or bank guarantees ranging from 10,000 THB to 200,000 THB depending on the license type (Local, Domestic, Inbound, or Outbound).
▪️Compulsory Insurance: Mandatory accident insurance for all tourists and guides.

The consequences for non-compliance are severe and extend beyond mere fines:
▪️Criminal Sanctions: Up to two years of imprisonment and/or fines up to 500,000 THB.
▪️Operational Shutdown: Immediate cease-and-desist orders and permanent business closure.
▪️Immigration Risk: For foreign directors, a conviction typically leads to the revocation of work permits and visas, followed by deportation.

Thai authorities are increasingly focused on substance over form, scrutinizing "nominee" structures and unlicensed online services. Ensuring your license and corporate structure are robust is the only way to safeguard your investment in Thailand’s tourism sector.
