An administrative divorce in Thailand provides a relatively simple, inexpensive and "no fault" option for couples seeking a marital dissolution.

The couple must hold a marriage certificate registered in Thailand or at a Thai embassy/consulate. The divorce must be consensual and have no disputes regarding any aspect of the marriage. Both parties must appear in person at the relevant Amphur (District Office).

𝗞𝗲𝘆 𝗖𝗿𝗶𝘁𝗲𝗿𝗶𝗮 𝗮𝗻𝗱 𝗥𝗲𝗾𝘂𝗶𝗿𝗲𝗺𝗲𝗻𝘁𝘀:

▪️Mutual Consent: Both parties must mutually agree to end the marriage.
▪️Registered Marriage: The marriage must have been registered in Thailand or at a Thai Embassy abroad.
▪️In-Person Presence: Both spouses must appear together at the district office at the time of registration. Proxies or lawyers may be present as witnesses or legal counsel, but cannot act on behalf of the spouses.
▪️No Disputes: There must be no disputes regarding any property, debt, alimony or child custody and support.
▪️Divorce Agreement: A written agreement (divorce agreement) covering the dissolution of the marriage, separation of assets, debts, alimony and child custody must be prepared, signed by two witnesses, and registered at the Amphur.

𝗗𝗼𝗰𝘂𝗺𝗲𝗻𝘁𝗮𝘁𝗶𝗼𝗻 𝗥𝗲𝗾𝘂𝗶𝗿𝗲𝗱:

▪️Original Marriage Certificate.
▪️Passports of both spouses.
▪️Thai National ID and House Registration for Thai spouses.
▪️For foreigners, a legalized translation of the passport copy.

Administrative divorces are processed in a single day at the local Amphur office.
If any of the above criteria cannot be met, the parties must go through a court divorce instead.

In the world of contracts, the distinction between "Best Efforts" and "Reasonable Efforts" determines the level of obligation required of a contracting party.

𝗧𝗵𝗲 𝗦𝗽𝗲𝗰𝘁𝗿𝘂𝗺 𝗼𝗳 𝗘𝗳𝗳𝗼𝗿𝘁

Not all obligations are created equal. Legal standards generally rank "effort" clauses based on the intensity of the obligation, often viewed on a sliding scale from most demanding to least demanding.

𝗕𝗲𝘀𝘁 𝗘𝗳𝗳𝗼𝗿𝘁𝘀
This is often interpreted as an obligation to leave no stone unturned. In many jurisdictions, this requires the party to take all steps that a prudent and determined person would take, potentially even if those steps result in a financial loss or a conflict with the party's own interests.

In Thai law, which is primarily governed by the Civil and Commercial Code (CCC), "effort" clauses may be interpreted based on the principles of good faith (Section 368) and the standard of care required in fulfilling obligations (Section 215) including other sections as relevant. While Thai law does not explicitly define or rank "best" vs. "reasonable" efforts in the same manner as common law, judicial interpretation generally ranks them based on the rigor required to meet the "true intent and purpose" of the contract

𝗞𝗲𝘆 𝗖𝗼𝗻𝘀𝗶𝗱𝗲𝗿𝗮𝘁𝗶𝗼𝗻𝘀:

𝗚𝗼𝗼𝗱 𝗙𝗮𝗶𝘁𝗵 𝗜𝗻𝘁𝗲𝗿𝗽𝗿𝗲𝘁𝗮𝘁𝗶𝗼𝗻: Thai courts use "good faith" and "good commercial practice" to interpret the intensity of efforts required (Section 171 and 368 CCC).

𝗢𝗯𝗹𝗶𝗴𝗮𝘁𝗶𝗼𝗻 𝘁𝗼 𝗣𝗲𝗿𝗳𝗼𝗿𝗺: Under Section 215, if a party does not perform in accordance with the "true intent and purpose" of the contract, the creditor can claim damages.
