Platform Fees Under Competition Law: When Does It Raise Competition Concerns?

Platform fees are often at the centre of debates about fairness and competition in the digital economy. But is the fee itself the problem—or merely a symptom of deeper market power?

In our latest article, we explore whether direct regulation of platform fees can effectively address competition concerns, and the potential unintended consequences of fee caps, including fee shifting, reduced transparency and changes to platform governance.

The key question is not simply “Is the platform fee excessive?” but rather:

“What market conditions allow the platform to impose that fee, and what alternatives are realistically available to its business users?”

Read the full article to explore how competition policy can look beyond the headline commission and address the underlying dynamics of platform power.

Thailand's Ministry of Digital Economy and Society (MDES) has issued a new notification clarifying the emergency procedures for obtaining court orders to suspend or remove unlawful computer data under the Computer-Related Crime Act. The notification provides guidance on what constitutes an "urgent necessity," outlines the expedited petition process, and identifies categories of online content that may be subject to emergency action.

The new framework has important implications for digital platforms, online service providers, and businesses that host or disseminate user-generated content. Organizations should review their content moderation policies, community guidelines, and internal procedures to ensure they are prepared to respond to urgent legal requests.

In this legal alert, we provide an overview of the MDES Notification, including its legal basis, procedural framework, and the practical implications for online platforms and digital service providers in Thailand.

On 27 July 2026, Kudun and Partners’ internship students had the opportunity to visit the Administrative Court as part of the firm’s internship development program. We would like to express our sincere appreciation particularly to Mr. Anan Kongkruapan, Advisor to the Office of the Administrative Courts, the officers of the Office of the Administrative Courts, and the Administrative Court for their warm hospitality and for generously sharing their expertise with our interns.

During the visit, the interns attended an informative session conducted by representatives of the Administrative Court, where they learned about the role and responsibilities of the Administrative Court, the principles of administrative justice, and the court’s role in reviewing the legality of administrative actions. They also gained a deeper understanding of the process for handling administrative disputes between public authorities and private individuals or entities, as well as the importance of transparency, accountability, and fairness in public administration.

In addition to the learning session, the interns were guided through the court facilities, allowing them to observe the environment in which administrative proceedings take place and gain a better appreciation of the practical application of legal principles.

The visit was led by Niruch Winiyakul, Partner, together with Bongkotkan Chumsai Na Ayudhya, Counsel; Songpol Pirunsarn, Senior Associate; Jamorn Pornponwat, Associate; and Tirarat Sukpummarin and Suranunt Boonkeawthong, Associates from Kudun and Partners. They accompanied the interns throughout the program, offering guidance and sharing practical perspectives to enhance the students’ understanding of administrative law and the legal profession.

This visit reflects Kudun and Partners’ commitment to providing our interns with meaningful learning opportunities beyond the workplace, enabling them to develop a broader perspective of the legal profession and better understand how legal concepts are applied in real-world settings.

Through our internship program, Kudun and Partners continues to support the development of future legal professionals by providing opportunities for practical learning, professional growth, and exposure to diverse areas of legal practice.
