It may come as a shock to some, as it did to Kara's family, that the Guidelines for the Assessment of General Damages in Personal Injury Cases, published by the State Courts in 2010, values the pain and suffering for loss of an index finger at only $10,000. The compensation of $170,000 largely comprised other claims such as the risk that her earning capacity would be affected, that she should be allowed to have better a prosthetic, and reimbursement for expenses incurred towards medical bills and care provided by her parents.

We must commend the defence lawyer and his clients who contacted us promptly and displayed empathy and accountability by mediating the matter fairly and amicably to spare the family the ordeal of court proceedings.

We are glad for Kara and her family who struck us as close knit and extremely positive people, as they get to move on with their lives. It remains a concern to us, however, that the level of damages for pain and suffering in Singapore may not adequately reflect the suffering of injured victims.

Lee Shergill LLP lawyers - Mr Raj Singh Shergill and Ms Desiree Koh Jia Min have been representing Mr Alam in this ongoing case where what was supposed to be a routine procedure left him paralysed because insufficient care was taken in the use of an anaesthetic needle. In the result it penetrated his spinal cord and caused irreversible damage.

To compound his misery, the insurers delayed compensation causing him to be stranded in Singapore and his hospital bill to spiral past a million dollars.
