HDB say Cannot
So 3 days ago we brought our clients to HDB branch. They are two sisters one 64 years old and the other is 56 years old. Both single and each own a 3 room flat.
Months back when they contacted us, their main concern was whether the surviving sister could have the flat. They have no children and no one to give the flat to. And they wanted only the other sister to have the whole flat with no contest. For most people, it is a simple fact of just writing a will. But for them, it’s very complicated with the MUIS law.
So hearing their concerns, we brainstorm together what are the best options for them.
Sell 2 flats and buy 1 unit together?
Sell 1 flat and transfer 50% share of the other flat to the other sister?
Sell 1 flat and sell 50% share to the other sister?
After discussion, we agreed that option 1 which means selling 2 flat and buying another is so much hassle for the sisters.
So we decided on selling 1 flat only. And after that, to have both sisters names in the other flat.
To make sure everything was smooth, we book an appointment with HDB to check if we can transfer 50% share to the sister.
Guess what? HDB says Cannot.
According to HDB, only three scenarios can transfers be allowed. Marriage, divorce and death.
For example:
1. Addition of co-owner
2. Removal of co-owner
3. Change (Replacement) of co-owner
4. Total change of owners
So since we have a No go from HDB, we went with option 3, which is to 50% share the sister.
