𝗕𝗿𝗮𝗻𝗱 𝗻𝗲𝘄 𝗱𝗼𝗲𝘀𝗻’𝘁 𝗮𝗹𝘄𝗮𝘆𝘀 𝗺𝗲𝗮𝗻 𝗽𝗲𝗿𝗳𝗲𝗰𝘁.

This Canberra Residences case is a good reminder that even newer developments can run into serious building issues.

According to The Straits Times, the MCST is suing the main contractor over alleged unresolved defects involving issues such as water seepage, popped tiles, corrosion, sagging cabinets and shattered balcony glass panels.

The contractor disputes the claims, so the court will ultimately determine where responsibility lies.

But from a property buyer’s perspective, there is one important point here:

Buying brand new does not guarantee a problem-free home.

Fortunately, buyers of new developments do have the benefit of a Defects Liability Period, which gives them a clearer avenue to report defects and seek rectification.

That protection is important.

However, this case also shows that some problems may not be so straightforward.

Certain defects may take time to surface. Others may require repeated rectification. And in more serious cases, the issue can drag on well beyond the Defects Liability Period, eventually becoming a dispute involving the MCST, developer, contractor or other parties.

This is why the Defects Liability Period should not be treated casually.

Owners should inspect properly, report genuine defects early, document them clearly and keep records of the rectification process — especially where the same problem keeps recurring.

At the same time, as a general principle, buyers should also make good use of this protection without abusing it. A defect warranty is there to address genuine defects, not to demand absolute perfection over every minor cosmetic issue.

In general, developers would also want to make good on genuine and reasonable defects raised during the Defects Liability Period, because it is in everyone’s interest for issues to be resolved properly and fairly.

𝗢𝗻𝗲 𝗹𝗲𝘀𝘀𝗼𝗻 𝗹𝗲𝗮𝗿𝗻𝘁:

👉 Brand new does not mean perfect. The real advantage is having a defect checking period of protection and recourse — so make full and reasonable use of it while it is available.

Because as this case shows, sometimes the defect may surface early…

but getting it fully resolved can take years.
