Here's an interesting case study! 6 siblings sued 2 brothers over the division of 8 properties of their parents!

Their parents owned a total of 8 properties. 2 were put under the names of relatives which were later transferred to their two sons (Thian & Nga). Another son (Tiong) has 1 property under his name and 3 others as joint owner. He acknowledged that these properties were only held in trust for his parents. However, Thian and Nga said the properties were intended to be given to them.

A letter from their father suggested that the properties were transferred to Nga and Thian from the relatives temporarily.

This saga could have been prevented had a Will has been done. Intentions will be clearly written out. The case has been closed as the 8 siblings have reached a private settlement.

There are many myths about writing a Will. Let us go through one by one in debunking them!

Myth #1: I am not rich. Therefore I do not need a Will.

Many people have this perception that a Will is only for the rich. NO! IT IS NOT! There is no sum too small to write a Will. The main intention of writing a Will is to ensure that our estate (property, savings, insurance payouts) is given to people that we care and love. Most importantly, to prevent any disputes!

According to the Straits Times article, many people are not aware about the things involved when writing a Will. As a result, there are many Wills deemed invalid by the court.

Many people are also unaware that make a Will is a 2 stage process.

The first stage is the planning phase and it is best to be done with a competent Estate Planner. The planning phase involves fact finding, analysis and recommendation which involve a proposal on how the estate should be distributed.

The second stage will be the implementation phase where legally trained professionals will draft the Will in accordance with the estate plan.
