A second successful citizenship appeal in the same week! ✅✅

Our client’s application for Swedish citizenship was rejected by the Swedish Migration Agency in June 2026, despite her having fulfilled the five-year habitual residence requirement under the previous legislation.

In its decision, the Swedish Migration Agency held that, following the legislative changes that entered into force on 6 June 2026 without any transitional provisions, our client’s application was to be assessed under the new legislation.

The Migration Court has now overturned the Swedish Migration Agency’s decision and remitted the case for a new decision.

We are very pleased with this outcome, which marks our second successful citizenship appeal this week. We hope to maintain this momentum as we continue pursuing several other appeals concerning the same legal issue. 🙌🏻

A positive decision from the Migration Court in a Swedish citizenship case! ⚖️ ✅

Our client had applied for Swedish citizenship, but the Swedish Migration Agency rejected her application on the ground that she did not fulfil the newly introduced seven-year habitual residence requirement for citizenship.

We appealed the decision on our client’s behalf and argued that the Swedish Migration Agency’s interpretation of the law was incorrect based on established precedent. The court agreed with our arguments, set aside the Migration Agency’s decision, and remanded the case to the Migration Agency for re-examination. 🇸🇪 👏

En till seger mot barnutvisning i domstol!🧑🏻‍⚖️⚖️✔️

Vår jurist Youstbi Djuanvat förordnades av staten som barnets offentliga biträde i domstolsärendet. Under processen gjordes det gällande att barnet har sina familjemedlemmar i Sverige och att ett avlägsnande skulle strida mot artikel 8 i Europakonventionen samt principen om barnets bästa.

Domstolen går på vår klients linje och avbryter utvisningen. Det fastställs nu att klientens utvisning inte kan anses förenlig med proportionalitetsprincipen eller principen om barnets bästa. Domstolen beviljar nu barnet tvåårigt uppehållstillstånd. ✨🇸🇪

⚖️✅ One mistake does not define a person—the Swedish Migration Agency ordered our client and his family to be deported on the basis of a minor traffic offence committed years earlier. We defended the position that the incident was an isolated and honest mistake by an otherwise law-abiding individual. The court agreed with our defence, allowing the appeal and setting aside the deportation decision.🌟

Seger i domstolen! ⚖️✅ Vår jurist Youstbi Djuanvat har företrätt en klient i egenskap av offentligt biträde förordnad av staten. Klienten har anfört att han inte kan återvända till Iran mot bakgrund av att han riskerar religiös förföljelse i Iran. Migrationsverket avslog ansökan och utvisade honom.

Migrationsverkets beslut överklagades till migrationsdomstolen, varvid det gjordes gällande bl.a. att klienten har gjort sin ateistiska övertygelse sannolik, bland annat genom omfattande skriftlig aktivitet i form av humanistiska artiklar. Domstolen bedömde att det kan föreligga en risk för förföljelse vid ett återvändande till Iran. Mot denna bakgrund upphävde domstolen Migrationsverkets beslut om utvisning.

Vi är stolta över att kunna göra skillnad i ärenden av stor betydelse för den enskilde. 🎉

Sveriges Radio har uppmärksammat ett av våra pågående ärenden där vår jurist Youstbi Djuanvat företräder en tonåring från Kina som har fått ett beslut om utvisning.

Vi biträder tonåringen där vi anför att hennes utvisning strider mot artikel 8 i Europakonventionen eftersom hon har tillbringat sina formativa år i Sverige och etablerat ett privatliv här. Den enda anledningen till att hon inte kan fortsätta bo med sin familj i Sverige är att hon har fyllt 18 år, en s.k. tonårsutvisning.

Vi inväntar nu domstolens avgörande och hoppas att vår klient beviljas uppehållstillstånd i Sverige.

Ännu ett positivt beslut! 🎉 En tonårsutvisning stoppad 💛 Vi har företrätt en ung klient från Filippinerna sedan 2023. Hon kom till Sverige som barn och hennes familj har numera beviljats svenskt medborgarskap. Migrationsverket ansåg att hon skulle utvisas ensam till Filippinerna eftersom hon nu hade fyllt 18 år.

Efter vårt överklagande upphävde domstolen Migrationsverkets utvisningsbeslut och återförvisade ärendet till Migrationsverket för ny prövning. Efter många månaders fortsatt handläggning har den unga klienten nu beviljats uppehållstillstånd i Sverige utan att behöva lämna landet. 🇸🇪

Victory in court! ⚖️ 🎉 The court has approved our appeal in one of our so-called “Sweden’s teen deportation” cases, involving children of expatriates who moved to Sweden when they were very young and who then faced deportation after turning 18. The court accepted our argument that our client, having grown up in Sweden, has a significantly stronger connection to Sweden than to her country of origin, and immediately granted her a two-year residence permit. ✅
