Opinion: Control over the major Internet platforms in Russia is increasing. In early February, the Upper House of Parliament in Russia proposed to block social networks for announcements of protests that were not coordinated with the authorities.

“At the moment, Russian authorities are trying to build an analogue of the Chinese censorship which consists of three filters. One intermediate filter already exists with us since 2013 – this is blocking of the resources with operators. Roskomnadzor and the authorities are building another filter under the law of the sovereign internet to install special equipment on the nodes of the telecom operators so that all the incoming and outgoing traffic could be filtered – an analogue of the Chinese firewall. They want to install the third filter at the level of social networks, "says Sarkis Darbinyan, managing partner of the Digital Rights Centre.

Today the prosecutor's office in Russia renounced their claim to block the site of crypto exchange aggregator Bestchange. Bestchange is represented by Digital Rights Center.
According to the lawyer Valeria Smirnova, the prosecutor explained the refusal to block the site with the provisions of 'Law about Digital Financial Assets' which came into force on the 1st of January 2021.
"In fact, entry into force of this law only proved the accuracy of our position, saying that the spread of information about cryptocurrencies has never been prohibited. The legislator only needed time to introduce new legal relations into the legal field,” said Valeria.

Russian President Vladimir Putin gave a reason of possible shut down of foreign Internet resources. As he said, he doesn't have any will to "artificially screw up and tighten" anything but, in the case of "hostile actions" maintained by such foreign sources, this becomes highly possible.

The recent news announced that Mastercard will support digital currency transactions. Unfortunately for Russia this news may not work due to the local legislation specificities.
The partner of Digital Rights Center law firm Mike Tretyak in his interview with Forklog noted that Mastercard implements transactions with digital assets primarily to pay for various goods and services. However the law about “Digital Financial Assets” directly prohibits accepting digital currencies as payment:
“Thus, clearly, it won’t be possible to use tools offered by Mastercard to buy coffee, pay for repairs or services of a personal trainer - it can only be used for the purchase and sale of cryptocurrencies and, possibly, DFA. There will be no settlements - no taxes, the math here is extremely simple”.
The law about “Digital Financial Assets” also prohibits the dissemination of information about the offer and acceptance of digital currencies as payment.
“This means that Mastercard is actually prohibited to share information about the possibility of paying with cryptocurrencies for goods, works and services with Russian citizens,” Tretyak said.

Binance website unblocked in Russia.

Digital Rights Center, the law firm representing world’s largest cryptocurrency exchange Binance, has achieved cancellation of the court decision to block the exchange’s official website in Russia. The Regional Court of Arkhangelsk overturned the decision to block the site of Binance crypto exchange in Russia on the 20th of January due to withdrawal of the claim by the prosecutor.

The original decision to block the site was issued by the Mirninsky court of Arkhangelsk region in June of 2020 based on the request of the local prosecutor who deemed dissemination of information about bitcoin traded on the exchange as “illegal and prohibited for dissemination in Russia”. Binance learned about proceedings against the exchange only several months later from the Roskomnadzor notice saying that their site is included in the list of the domain names and URLs of websites containing information prohibited for dissemination in Russia.

Mikhail Bautin, the Digital Rights Center partner who represented Binance in courts, noted that failure to notify Binance about commencement of initial proceedings was a “gross procedural violation”. As a result, the legal team had to first restore the missed appeal deadline and only then file the appeal. Mr. Bautin specified that the prosecutor’s office “was basically forced to abandon the claim”.

Our comment: On the 14th of December an investigation of the proposed poisoning of Alexey Navalny by a group of FSB officers has been published. According to it the officers followed Alexey in every his trip across Russia for a couple of years.
This investigation has lead to discussions about the possibility to get the data about the use of phones and plane travels without the involvement of Secret Service.
“The entire investigation is based on the data they bought at the black market, to collect the information all holes and vulnerabilities of the state information systems were used, - says Sarkis Darbinyan, partner of Digital Rights Center. - In terms of legislation, they could breach the privacy and get an unauthorised access to the protected systems. It is possible that the citizens mentioned in the investigation will file a civil suit against Navalny, but judicial practice shows that the plaintiffs will not be able to receive large payments - a maximum of 10-20 thousand rubles.” (~ 137 - 274 USD)
