How much can procedural rules really improve the way evidence is handled in arbitration?

Panel 6 will explore the various tools and procedural mechanisms for efficient and proportionate taking of evidence in arbitration โ€” under the DIS Rules, but also in comparison with approaches under other institutional rules and widely used soft-law instruments.

The panel aims to move beyond theory and open a practical conversation โ€” among speakers and with the audience โ€” about what an arbitral institution can realistically do โ€” through rules, guidance, templates โ€” to help tribunals and parties conduct evidence-taking efficiently, without undermining due process or the partiesโ€™ right to present their case.

Damages are the ultimate battleground in Investorโ€“State dispute settlement (ISDS). While liability attracts headlines, valuation evidence decides outcomes.

Panel 5 explores how tribunals assess damages claims: the methodologies, evidentiary burdens, and credibility of expert evidence that underpin billion-dollar awards. It will consider how legal standards interact with economic analysis, how tribunals distinguish robust valuations from speculative ones, and what evidentiary trends are shaping the evolving practice of quantum in ISDS. Recent work by UNCITRAL Working Group III has brought renewed focus to the evidentiary foundations of damages and valuation in ISDS.

Expert evidence lies at the heart of modern international arbitration, particularly in complex disputes involving quantum, valuation, construction, engineering, or environmental issues.

This panel examines the evolving standards governing expert testimony - from selection and independence to cross-examination, hot-tubbing, and the ethical duties of experts and counsel. It explores how tribunals assess expert credibility, weigh competing methodologies, and ensure procedural fairness while maintaining efficiency and cost-effectiveness.

Document production remains one of the most debated stages of international arbitration. While it is designed to ensure fairness and access to relevant evidence, it can also become costly, time-consuming, and strategically manipulated.

This panel explores how tribunals manage document production between differing legal traditions, how the IBA Rules on the Taking of Evidence have shaped modern practice, and how technology and ethical expectations are transforming disclosure in arbitral proceedings.

In an era of efficiency drives, soft law harmonization, and digital case management, some practitioners question whether traditional evidentiary debates still hold relevance in international arbitration. This panel reaffirms that evidence remains the backbone of arbitral reasoning and procedural legitimacy, shaping outcomes, ensuring due process, and maintaining confidence in the arbitral process.

The discussion explores how arbitral tribunals weigh, test, and interpret evidence, and why evidentiary standards remain essential to the integrity of the process, even in a system designed for flexibility and party autonomy.
