🎤 Mihnea Galgoțiu-Săraru, Partener, Reff & Asociații | Deloitte Legal, a participat în calitate de speaker la evenimentul „Totul despre ROBOR”, organizat de JURIDICE.ro, în contextul dezbaterilor curente privind funcționarea indicilor de referință din piața bancară și implicațiile acestora pentru instituțiile de credit și clienții acestora.
Tema abordată a fost „Acțiunile în despăgubire în materia dreptului concurenței”.

💬„Acțiunile în despăgubire pentru încălcări ale dreptului concurenței fac obiectul unui cadru legal obligatoriu la nivelul Uniunii Europene – Directiva 2014/104/UE, transpusă în România prin OUG nr. 170/2020 – din care rezultă două principii fundamentale.
În primul rând, avantajele pe care legea le asociază unei decizii a autorității de concurență pot fi valorificate doar după ce aceasta devine definitivă în urma controlului judiciar, iar procesele de anulare care urmează vor dura, cu siguranță, foarte mulți ani.
În al doilea rând, chiar și o constatare definitivă a unei încălcări nu conferă un drept automat la compensații: în această materie nu discutăm despre rambursări, ci despre repararea unui prejudiciu - dacă și în măsura în care acesta există, iar legislația impune instanțelor o analiză complexă privind legătura de cauzalitate, existența și plauzibilitatea prejudiciului și, mai ales, cuantificarea acestuia”, a declarat Mihnea Galgoțiu-Săraru.
