📢 28 iunie 2025 — Start oficial pentru Legea nr. 232/2022 privind accesibilitatea produselor și serviciilor. Sunteți pregătiți?

Legea nr. 232/2022 transpune în România Directiva (UE) 2019/882 („European Accessibility Act”), aducând obligații clare pentru operatorii economici care:
- introduc pe piață produse cu componente digitale;
- furnizează servicii digitale cu interfețe utilizator (site-uri web, -aplicații mobile, terminale interactive);
- activează în domeniile comerț electronic, servicii bancare, telecomunicații sau transport de pasageri.

✅ Ce implică pentru e-commerce?
Pentru serviciile e-commerce (site-uri și aplicații mobile), cerințele-cheie sunt:
- Produsele utilizate să fie accesibile;
- Informațiile privind serviciul trebuie oferite prin multiple canale senzoriale (vizual, auditiv), în mod clar și ușor perceptibil, în formate text accesibile și adaptabile;
- Conținutul non-text trebuie să aibă alternative accesibile;
- Interfețele digitale trebuie să fie coerente, previzibile și compatibile cu tehnologiile de asistare (de exemplu, cititoare de ecran);
- Serviciile de suport (chat, centre de apel) trebuie să fie accesibile.

📌Când devine obligatorie conformarea?
- Pentru toate serviciile digitale și produsele lansate după 28 iunie 2025, cerințele se aplică imediat.
- Prin excepție, furnizorii de servicii pot continua să își furnizeze serviciile până la 28 iunie 2030, utilizând produsele pe care le-au folosit pentru a furniza servicii similare înainte de această dată.
- De asemenea, contractele de furnizare de servicii încheiate înainte de 28 iunie 2025 rămân valabile fără modificări până la expirare, dar nu mai mult de cinci ani de la respectiva dată.
- Terminalele self-service existente pot fi utilizate pentru servicii similare până la maximum 20 ani de la instalare.

⚠️Riscuri de neconformare
Amenzi între 5.000 lei și 15.000 lei, la care se pot adăuga: retragerea produsului de pe piață, suspendarea activității sau retragerea autorizației de funcționare.

On Friday evening we had the honor of participating in the Romanian Legal Awards Gala, an occasion made even more special by the recognition of our firm with the "Rising Star" 2024 distinction.
This distinction holds tremendous significance for us, as it confirms that our efforts have not gone unnoticed and that we’ve made a mark in a relatively short time. It is especially meaningful as it comes exactly one and a half years since the founding of &PRODESCU.

📢 Change alert on contravention legislation

While in the past few months - and especially in the last week, we have undergone an inflation of legislative changes - mainly of a fiscal nature - on which we have all been focusing, we should not overlook a change with impact in the area of contravention liability - also adopted through the law on "tax reform".

In brief, Law 296/2023 eliminates - as of November 11th, 2023 - 🔖 the facility of paying half of the minimum fine within 15 days as of the serving of the contravention report, for certain situations in the tax, accounting and financial fields.

The amendment covers a number of fines sanctions foreseen in the following normative acts:
📌 Law no. 207/2015 on the Fiscal Procedural Code;
📌 Law no. 227/2015 on the Fiscal Code;
📌 Accounting Law no. 82/1991;
📌 Law no. 70/2015 on the strengthening of financial discipline regarding cash receipts and payments;
📌 GEO No 28/1999 on the obligation for economic operators to use electronic fiscal cash registers;
📌 GEO no. 41/2022 for the establishment of the National System for monitoring road transport of goods with high fiscal risk RO e-Transport;
📌 Law 296/2023 itself - which provides certain sanctions to which this limitation will apply.

This week we've had the pleasure of attending .

It's been great to step away from the usual day to day and let ourselves off the hook, a bit, of the (good) chaos it has been in the last month, spending time with esteemed peers and uncovering insights into the challenges and prospects for businesses in the industry.

We were delighted to hear the views of specialists in retail, FMCG, logistics, delivery and e-commerce especially in terms of future trends.

We frankly think this is the sort of event that can bring real added value to attorneys who are active in this sphere, particularly as we found some of the discussed topics to be a real source of learning.

👨‍⚖️ ⚖ The European Court of Justice (ECJ) has rendered on October 5th, 2023 the Judgment in Case C‑565/22, considering preliminary ruling when a consumer can withdraw from a distance selling contract.

📍 The Austrian Supreme Court sought interpretation from the ECJ on the consumer rights Directive EU 2011/83, in a case concerning the Association for Consumer Information in Austria and a company operating in the field of online learning platforms - which as a business model allows a 30-day free trial for the first subscriptions, which become chargeable after this period and auto-renew unless terminated.

This decision will be of interest to all businesses who operate subscription contracts in EU serving consumers, since ECJ expressly stated that:
💡 Initially free subscriptions that are thereafter automatically renewed (for a payment) can be cancelled once.
🔦 Nonetheless, customers may have a new right of withdrawal, if they weren’t specifically, plainly and accurately told, about the total costs of the subscription to keeping the membership - i.e., that after the initial free period, this delivery of services becomes a paid one.

📣 On Thursday, 14th of September, the ECJ issued a press release on Case C-27/22, which focuses on the "ne bis in idem" principle applicable to sanctions for unfair commercial practices.

In the meantime, the provisional version of the judgment in its entirety has been published with the official website - including in Romanian - see link in the first comment.

The judgment involves Volkswagen Group Italia (VWGI) and Volkswagen Aktiengesellschaft (VWAG), whereas VWGI and VWAG were fined €5 million by Italy's competition authority in 2016 for unfair practices concerning diesel vehicle marketing and misleading advertisements about emission standards, whilst in Germany, the Public Prosecutor’s Office of Braunschweig imposed a €1 billion fine on VWAG for breaching duty of supervision regarding the emission software in 2018 - VWAG paid and didn't challenge this decision, making it final on June 13, 2018.

⚠ VWGI and VWAG challenged the Italian fine, citing the "ne bis in idem" principle, which prohibits penalizing someone twice for the same “crime” (i.e., administrative offense).

💡 The ECJ affirmed that the "ne bis in idem" principle stops proceedings assimilated to criminal matters, for the same facts, from continuing if a final decision on the matter already exists - even if that conviction is subsequent to the date of the decision imposing that fine, but became final before the judgment on the action against that decision became res judicata. This holds true even if the facts from different proceedings are just similar, not identical.

The ECJ emphasized fairness in ensuring entities aren't punished multiple times for the same offense, but provided conditions for exceptions:
1. Duplication of proceedings shouldn't excessively burden the person.
2. Clear rules should predict potential duplications.
3. Proceedings should be coordinated and conducted within a close timeframe.

📣 The Framework Control Procedure of the National Authority for Consumer Protection, applicable from August 2023, has undergone significant changes with regard to:

📌 Removal of body cams & usage of audio-video recording (by work phones)
📌 Involvement of DGCSPAE in the control activity of the commissioners
📌 Counselling business operators
📌 Voluntary control
📌 Application of seals and unsealing
📌 Introduction of the control sheet
📌 Safety Gate System

💡 These changes appear to have been adopted to address some of the Authority's previous concerns and also to accommodate new conditions imposed on the Authority by other authorities.

Yesterday evening we attended the 4th of July Party traditionally organized by AmCham Romania.

We are grateful for having been able to join in such an important gathering for the AmCham community - to celebrate both the U.S. Independence Day and 30 years of AmCham in Romania! 🎉

Although the rain tried to spoil our plans for having a good time and networking, it didn't succeed, yesterday evening being for us an opportunity to meet again with the wonderful AmCham team, many of our peers in the legal field, clients and business partners, as well as with some of our lifelong friends (from when we were in elementary school).

Thank you AmCham Romania for the invitation to participate in this year's 4th of July celebration!
