𝐓𝐡𝐞 𝐖𝐢𝐧𝐝𝐨𝐰 𝐈𝐬 𝐂𝐥𝐨𝐬𝐢𝐧𝐠: 𝐒𝐭𝐫𝐚𝐭𝐞𝐠𝐢𝐜 𝐓𝐚𝐱 𝐑𝐞𝐜𝐨𝐯𝐞𝐫𝐲 𝐢𝐧 𝐏𝐨𝐫𝐭𝐮𝐠𝐚𝐥

Non-resident property owners who sold real estate in Portugal between 2021 and 2022 may still have the opportunity to 𝐫𝐞𝐜𝐨𝐯𝐞𝐫 𝐨𝐯𝐞𝐫𝐩𝐚𝐢𝐝 𝐜𝐚𝐩𝐢𝐭𝐚𝐥 𝐠𝐚𝐢𝐧𝐬 𝐭𝐚𝐱 following the European Court of Justice (ECJ) ruling that reshaped Portugal’s taxation framework.

However, for many 2021 transactions, the legal deadline to initiate recovery procedures expires on 30 June 2026.

The amendment to the Portuguese Nationality Law was 𝐨𝐟𝐟𝐢𝐜𝐢𝐚𝐥𝐥𝐲 𝐩𝐮𝐛𝐥𝐢𝐬𝐡𝐞𝐝 𝐭𝐨𝐝𝐚𝐲 𝐢𝐧 𝐭𝐡𝐞 𝐏𝐨𝐫𝐭𝐮𝐠𝐮𝐞𝐬𝐞 𝐎𝐟𝐟𝐢𝐜𝐢𝐚𝐥 𝐆𝐚𝐳𝐞𝐭𝐭𝐞 𝐚𝐧𝐝 𝐟𝐨𝐫𝐦𝐚𝐥𝐥𝐲 𝐞𝐧𝐭𝐞𝐫𝐬 𝐢𝐧𝐭𝐨 𝐟𝐨𝐫𝐜𝐞 𝐭𝐨𝐦𝐨𝐫𝐫𝐨𝐰.

This is a major change to the Portuguese nationality regime, particularly for applications based on legal residence in Portugal.

The minimum legal residence period required for naturalisation will increase to:

• 𝟕 𝐲𝐞𝐚𝐫𝐬 for EU and CPLP nationals
• 𝟏𝟎 𝐲𝐞𝐚𝐫𝐬 for nationals of other countries

Most importantly:
𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥𝐢𝐭𝐲 𝐚𝐩𝐩𝐥𝐢𝐜𝐚𝐭𝐢𝐨𝐧𝐬 𝐚𝐥𝐫𝐞𝐚𝐝𝐲 𝐬𝐮𝐛𝐦𝐢𝐭𝐭𝐞𝐝 𝐰𝐢𝐥𝐥 𝐍𝐎𝐓 𝐛𝐞 𝐚𝐟𝐟𝐞𝐜𝐭𝐞𝐝 𝐛𝐲 𝐭𝐡𝐞 𝐧𝐞𝐰 𝐫𝐮𝐥𝐞𝐬.

The law expressly establishes that pending administrative procedures will continue to be governed by the previous legal framework.

Although the law formally enters into force tomorrow, the Government still has 𝟗𝟎 𝐝𝐚𝐲𝐬 to implement the necessary regulatory amendments.
