Two hundred thousand immigration cases pending in administrative courts. More than five hundred thousand nationality applications stuck at the Institute of Registries and Notaries. A public agency operating with technology from the early 2000s. Lawyers unable to access information about their clients—neither by email, nor by phone, nor by letter. The only form of communication is, very often, physical presence at a door that doesn't always open.

Behind each of these numbers is someone who left home to rebuild their life—and who found a State with its back turned. The mother who has been waiting for two years for a family reunification that never comes. The worker who pays into Social Security every month and cannot obtain a residency permit. The lawyer who goes to the AIMA door, waits for hours, and returns without an answer."

Deux cent mille dossiers d'immigration sont en attente devant les tribunaux administratifs. Plus de cinq cent mille demandes de nationalité sont bloquées à l'Institut des registres et des notaires. Un organisme public qui fonctionne avec des technologies du début des années 2000. Des avocats incapables d'accéder aux informations concernant leurs clients, ni par courriel, ni par téléphone, ni par courrier. SUBMITTING MISSING DOCUMENTS.
RESIDENCY PERMIT PENDING CASES.

"AIMA informs applicants that they do not need to go to AIMA stores to submit missing documents related to Residence Permit applications initiated with AIMA.

This procedure can be done exclusively online, through the Contact Form.

The applicant must access the Contact Form and select:

Subject Type > Residence Permit

Subject Subtype > Submission of documents for inclusion in ongoing applications only at AIMA

And follow the instructions presented in the Form.

The applicant must indicate the requested data, including the Process Number, available on the application receipt, and attach scanned copies of the necessary documents, namely those that are missing and that are mentioned in the notification received.

Each file can be up to 10MB and between 3 and 5 files should be sent.

Note: This form is not applicable to processes underway via the Renewal Portal and the services.aima.gov platform."

Os titulares de autorização de residência para estudantes, que não tenham concluído o plano de estudos e que se encontrem a trabalhar, podem solicitar a concessão de autorização de residência temporária, ao abrigo da alínea j), do n.º 1 artigo 122º da Lei n.º 23/2007, de 04/07, desde que não se tenham ausentado de Portugal.

O pedido deve ser submetido através do Formulário de Contacto, contactenos.aima.gov.pt, selecionando:
Tipo de Assunto > Autorização de Residência Subtipo de Assunto > Autorização dispensa de visto de residência - Art 122 - alinea j)

Devem ainda ser anexados todos os documentos legalmente previstos.

The Proof of accommodation must always be accompanied by a sworn statement from the applicant, stating their residential address and mentioning the **legal situation underlying the right to use the property ** (as per the template on the AIMA website available at (link: https://aima.gov.pt/pt/impressos-e-minutas text: forms and templates) and:

a. Access code to the permanent property certificate or valid physical certificate, as proof of ownership/usufruct;

b. Rental agreement showing the applicant's identification and rent receipt for the previous month, as proof of rental;

c. Loan agreement and valid permanent property certificate, as proof of the loan.

If the applicant **is not identified in the rental or loan agreements**, they must provide the following on the appointment:

a) a statement by the applicant themselves – under their word of honourand under criminal liability for any false statements– stating that they actually reside at the location, the number of theland registry description of the rented property and the basis on which they reside at the location(whether lease/loan for use), as well as the full name and NIF/NIPC of theowner who has granted them the property for housing;

b) Certificate issued by the Tax Authority (AT) statingthe tax domicile, issued less than 30 days ago and clearlyidentifying the applicant's tax domicile.

In special cases involving accommodation for students attending vocational/secondary/higher education:

a. The rental agreement signed by the school and the private entity
may be presented, accompanied by a certified statement individually mentioning the students who actually reside in the accommodation, if this information is not included in the agreement;

b. Alternatively, a duly certified statement from the educational establishment may be submitted, under oath, attesting to the individual residence of the student(s) and the legal situation underlying the use of the property;

c. University residences: a certificate from the higher education establishment may be submitted, attesting that the applicant is entitled to accommodation.

**Notes**
- Certificates issued by Juntas de Freguesia are not accepted as proof.
- AIMA will analyse the number of residents declared per accommodation.

I - Por força do disposto no artigo 244.º n.º 2 do Código de Procedimento e de Processo Tributário, quando a Fazenda Nacional conduz (solitariamente) a execução fiscal, em princípio, não pode ver o seu crédito satisfeito pelo produto da venda do imóvel em que habita o devedor. Mas quando numa execução comum, ao nela reclamar um crédito fiscal, vai à "boleia" de um particular, não só é possível vender o imóvel, como também a Fazenda Nacional pode, por essa via, acabar por ver o seu crédito pago (no todo ou em parte).

II - Numa execução comum que, depois de ter sido declarada extinta, se renovou por exclusiva iniciativa do Ministério Público em representação da Fazenda Nacional (artigo 850.º n.º 2 CPC), tendo em vista a cobrança de um crédito fiscal, e em que, desde que se reiniciou, é unicamente impulsionada por si (Ministério Público), estamos numa situação materialmente igual à que estaríamos se, em vez de o crédito ter sido aqui reclamado, para a sua cobrança tivesse sido movida uma execução fiscal.

III - Nesta singular situação processual deve aplicar-se, por analogia, o disposto no n.º 2 do artigo 244.º do Código de Procedimento e de Processo Tributário, não permitindo, assim, a venda do imóvel penhorado onde residem os executados.
