💼 Hearing without the need to travel? It’s possible thanks to online hearings

Just a few years ago, participating in a hearing for someone living abroad meant having to organize travel, take time off, and appear in court. Today, technology allows many proceedings to be conducted effectively regardless of the client’s place of residence 🌍

The best example of this is today’s hearing, during which we successfully brought to a conclusion the case of one of our clients living in the USA ✅ 🤝

During the session, the parties reached an agreement and in detail regulated all matters related to their minor child 👨‍👩‍👧

Online hearings are not only convenience. They also mean:
✔️ time savings,
✔️ lower costs,
✔️ no need to travel,
✔️ the ability to effectively participate in proceedings from anywhere in the world

If you live outside Poland and need legal assistance, remember — distance does not have to be an obstacle📍✈️🌍

Great news at the end of the week – a positive decision on interim protection! ⚖️✨🎉

📅 After nearly 2 years of proceedings, 2 expert opinions 🧠📊, and numerous hearings 🏛️, we have successfully obtained a court order securing the residence of the minor children with our client

The case concerns a complex family dispute between polish 🇵🇱 and spanish 🇪🇸 citizens and has been characterized by significant dynamics ⚡ and legal complexity 📚⚖️

Of course this is not the end of the proceedings – we continue to fight for full legal protection of our client’s situation and further favorable outcomes 📈 💪

🧩⚖️ This case is another reminder that determination, consistency, and a well-planned litigation strategy are crucial in family law matters

❗️👨‍⚖️ Can a parent be fined even if the child does not want contact with the other parent?

⚖️ The latest resolution of the Supreme Court (III CZP 20/25) may significantly change the practice in family law cases. The Supreme Court held that a child’s refusal to have contact does not exclude the possibility of imposing a financial penalty 💰 on a parent for failure to comply with a court order regarding contact

🚨This is a groundbreaking position that clearly contradicts the previous line of case law and may have major implications for all parents involved in disputes concerning contact with a child 👨‍👩‍👧‍👦

➡️ We discuss this important ruling in more detail, its consequences, and its potential impact on future family law cases in our latest article on the law firm’s blog 📚

🤓We invite you to read our publication 👉✨ https://divorceinpoland.com/lack-of-contact-with-a-child-despite-the-childs-objection-and-financial-penalties-the-new-position-of-the-supreme-court-iii-czp-20-25/

🔎 Another legal opinion completed

In the past week, we worked on a legal opinion for our Client residing in Malta 🇲🇹

👥The case concerned his right to maintain contact with his former partner’s child – despite the fact that he is not the child’s biological father

➡️ What is crucial in this case ?

The lack of a biological bond does not preclude the possibility of seeking contact with the child.

According to the Polish Family and Guardianship Code:
🔹the right to maintain contact with a child may also be granted to persons other than parents 👨‍👩‍👧
🔹the child’s best interests are decisive ⚖️
🔹what matters is the actual relationship and the role a given person has played in the child’s life (a developed bond) ❤️

💭This means that individuals who have been important in a child’s life – cared for them, raised them, supported them on a daily basis – are not deprived of legal protection

🏠 Purchase of real estate by spouses and lack of one spouse’s entry in the land and mortgage register

In practice, it often happens that when purchasing real estate, only one of the spouses is entered in the land and mortgage register. The reasons vary – formal, organizational, and sometimes purely technical

👉 It should be emphasized that the land and mortgage register does not always reflect the actual legal status of the property

In such situations, it is possible to assert one’s rights under Article 10 of the Act on Land and Mortgage Registers and Mortgage – i.e. to demand that the content of the register be brought into conformity with the actual legal status

🌍 What if one of the spouses is a foreign national?

As a general rule, acquisition of real estate by a foreigner requires a permit

However, Article 8 of the Act on the Acquisition of Real Estate by Foreigners provides for important exemptions from this requirement, including situations where:
✔ a foreigner acquires real estate jointly with a spouse who is a Polish citizen,
✔ certain residence conditions are met (e.g. permanent residence permit or EU long-term resident status),
✔ the acquisition concerns specific types of real estate or statutorily exempt situations

📌 Takeaway:
Neither the lack of entry in the land register nor the citizenship of one of the spouses alone determines the legal status of the property

In the past month, our law firm has taken on 3 new cases aimed at bringing the content of land and mortgage registers into conformity with the actual legal status ⚖️📑🏠

⚖️ New NSA ruling on same - s*x marriage

💍 ➡️ In March 2026, the Supreme Administrative Court (NSA) obliged a civil registry office to transcribe a same-s*x marriage certificate concluded abroad 🌍

📌 The ruling followed a CJEU judgment of 25 November 2025, case C-713/23

What does this change?
❌ authorities can no longer automatically refuse transcription of such marriages
⚖️ EU law and CJEU case law play a key role
🚶‍♂️ the obligation to recognize arises where lack of transcription limits EU citizens’ rights

❗What is important:

📜 the ruling does NOT introduce same-s*x marriage in Poland
🔎 however, it does require recognition in specific situations under EU law

🗣️ ⚖️ The debate also includes critical voices:
▫️pointing to a potential conflict with the Polish Constitution
▫️and the limits of EU law’s influence on the national legal order

💼 What does this mean in practice ?
📝 possibility to obtain transcription of a foreign marriage certificate
🤝 easier exercise of administrative and civil rights
🔄 need for a shift in current administrative practice

📌 This is another example of the direct impact of EU law 🇪🇺 on the application of Polish law – even without legislative changes
