MOS 2.0 and CUKR cards: the start date announced on a Friday evening tastes the best

Those who have worked with me know that I've often repeated: the most important changes are announced on Friday evenings. And this time, my "prediction" has come true. Happy shortened weekend! ☕📅

According to official announcements in Monitor Polski, the digitalization process and new rules for Ukrainian citizens are entering a decisive phase:
🗓️ The MOS 2.0 system (electronic residence permit applications for all foreigners) starts on 27 April 2026.
🗓️ CUKR residence cards (for eligible Ukrainian citizens) start on 4 May 2026.

⚠️ PAPER APPLICATIONS: If you plan to submit your application the "old way" (in paper version), it must physically reach the office before the MOS 2.0 launch date. Remember: the postmark date will not matter! 🛑📯

🎓 For foreign students: This is the last call to avoid the trap of mandatory university annexes, which I wrote about in my earlier LinkedIn post.

🇺🇦 For those applying for CUKR: This is the best time to prepare documentation before the system is overwhelmed by thousands of applicants.

From the frying pan of the expiration of Special Act on Ukrainian citizens into the fire of digitalization? Perhaps. But those who prepare now will go through these changes much more calmly. ✅✍️

🚨 URGENT WARNING: Changes to Polish Residence Permit Application System (MOS 2.0) 🚨

🖥️ New Electronic Application System (MOS 2.0)

Effective Date: The new system that will accept only electronic applications is planned for April 2026.

The significant changes to Poland's residence application system, announced to take effect from 2026, are now close to being implemented.

Due to this, today (17th of March) authorities have issued important warnings about the introduction of the new electronic system (so-called MOS 2.0).

⚠️ Critical Transitional Advice

⚡️ URGENT! Individuals whose legal stay in Poland is expiring in the period from mid-March to the end of April 2026 are strongly advised not to delay and to submit their application for a residence permit in the paper version as soon as possible.

🛑 CRITICAL INFORMATION!
👀 Monitor Closely: You must carefully monitor information regarding the launch date of the new MOS portal.
✉️ Delivery Deadline: The paper application must be delivered to the Immigration Office before the MOS portal is officially launched.
❌ Mailing Date Does Not Count: The date of mailing does not count.
🚫 Consequences: If the application sent by mail is received after the launch date, it will not be processed at all.

🖋️ Президент подписал новый закон о помощи гражданам Украины

Президент Польши подписал закон, который завершает действие некоторых положений так называемого «Спецзакона» (specustawa ukraińska).

🗓️ Закон вступает в силу 5 марта 2026 года.

Вот самые важные изменения в двух словах:

🛡️ Временная защита (легальное пребывание)

* Продление: Временная защита (статус UKR) продлена до 4 марта 2027 года.
* Документы: Срок действия документов на пребывание, который истек после 24 февраля 2022 г., автоматически продлен до этой же даты.

📂 Процедуры получения ВНЖ (карт побыту)

* Карты CUKR: Закон вносит небольшие изменения в эту процедуру, но не устанавливает точную дату старта (в настоящее время запуск ожидается в апреле).

* Отмена защиты: С 5 марта этого года отменяется механизм, который защищал от негативных решений (ранее вместо отказа выдавали решение на 1 год). Теперь риск получения отказа возрастает.

📅 Важные сроки и обязанности

⚠️PESEL UKR (без паспорта): Лица, получившие номер PESEL UKR без предъявления паспорта или другого документа с фото (на основании заявления/oświadczenia), обязаны подтвердить свою личность в гмине (urząd gminy) до 31 августа 2026 г.

* Выезд из Польши: Выезд из страны на срок более 30 дней означает потерю временной защиты. Исключений не будет (даже в случае служебных командировок).

💼 Работа

* Система уведомлений (powiadomienia) o трудоустройстве сохраняется еще на 3 года.
* Это касается как граждан Украины со статусом UKR, так и тех, у кого этого статуса нет.

🏢 Хозяйственная деятельность (JDG / ИП)

* Новые правила: С 5 марта 2026 г. мы возвращаемся к общим правилам ведения бизнеса иностранцами.
* Кто сможет открыть ИП: в основном обладатели статуса UKR и лица, имеющие "сильные" виды ВНЖ (например: Blue Card).
* Приобретенные права: Фирмы (JDG), зарегистрированные до 5 marca 2026 r., могут продолжать деятельность.

🚨 Planned Changes for Citizens of Georgia, Colombia, and Venezuela on Working in Poland

If you are a citizen of , , or (or an employer planning to hire from these countries), please pay close attention to a new planned regulation from the Ministry of Labour.

What is Changing? 🧐

The Polish government is planning to introduce a regulation that will prohibit working in Poland while staying under the visa-free (biometric) regime for citizens of these three countries.

Currently: Many citizens fromi these nations enter Poland without a visa and begin working based on a work permit.

The New Rule: Once this change takes effect, having just a biometric passport and a work permit will not be enough to work legally.

The Requirement: To work in Poland, citizens of these 3 countries will be required to obtain a work visa at a Polish consulate before starting their employment.

The Sequence: Work permit comes first ➡️ Work visa comes second.

The Risk: Even with a valid work permit, working during a visa-free stay would be considered illegal for citizens of these countries.

Why the Change? 🛡️

The Ministry of Foreign Affairs and the Ministry of Interior have noted concerns regarding high migration risks and potential misuse of the visa-free regime.

Verification: Requiring a visa allows Polish consuls to verify the actual purpose of entry and the applicant's background.

Safety: This change aims to help eliminate illegal immigration and exploitation of foreign workers.

Summary of Key Facts 📋

Target Countries: 🇬🇪, 🇨🇴, and 🇻🇪.

Planned Implementation: The second quarter of 2026.

Current Status: Early stage. The regulation was officially added to the list of planned regulations in February 2026.

The Goal: Increase control over the employment of citizens from these specific nations.

This does not mean the Polish labor market is closing for you completely.

It simply means a path of working on a biometric passport is being removed and other routes (visa, temporary residence permit) will continue.

New Salary Threshold for the EU Blue Card (2026)!

Important news for highly skilled professionals planning to relocate to or already staying in Poland.

On February 9, 2026, the Polish Statistics Office (GUS) published the average salary data for 2025. This announcement has automatically raised the financial bar for EU Blue Card applicants.

1. The New Financial Threshold 💰

Based on the latest data, the new minimum threshold is now PLN 13,355.34 gross per month.

Keep in mind that this level is increased every year in February.

2. When to use the Old vs. New Threshold? 📅

The decisive factor is the date you submit your application:

Applications submitted in 2025: These fall under the old salary threshold.

Applications submitted from Jan 1, 2026 onwards: These applications must meet the new salary requirement of PLN 13,355.34 gross.

As you can see, although the new salary level was announced on 9th of February, it extends also to applications made in January and early Ferbuary 2026.

This is what many unqualified immigration "agents" get wrong, by thinking that new salary level applies only to applications submitted after February 9, 2026. Such mistakes can cost you a refusal!

3. The Major June 2025 Changes – Is your agent up to date? 🔄

Also, in June 2025, the regulations regarding the EU Blue Card underwent a massive reform.

As a result, at the moment we have two sets of rules:
- rules for "old" Blue Cards (issued before June 2025)
- rules for new Blue Cards (issued after introduction of the new regulations).

In a landscape of such dynamic shifts, verifying the accuracy of your information is more critical than ever.

Immigration law is not just about filling out forms; it is about a strategy built on hundreds of successfully supervised Blue Card cases. I started handling Blue Card cases back in 2016.

Do not risk a refusal simply because your agent missed the latest GUS publication or a major amendment from last year.

🎓🚨 ARE YOU A FOREIGN STUDENT IN POLAND? READ THIS BEFORE YOU GO TO WORK IN 2026 🚨🇵🇱
(especially if your agent says: “don’t worry, it’s fine”)

It’s 26 January 2026.

And (un)surprisingly… many immigration agents still give advice based on information from 2024.

Here are 2 very common traps I see all the time in the last period 👇

❌ 1. “I’m a full-time student, so I can work without a permit”
This is NOT always true.

Since 1 December 2025, you can work without a permit only if:
✔️ your university is officially approved by a Ministry
OR
✔️ your school is on the list of institutions exempt from this approval

⚠️ Important:
• If your school is NOT on the lists → your work may be illegal
• Some private universities have a temporary grace period until 30 June 2026,
• However, If your university does not benefit from this grace period - you lost right to work in Poland on 1 December 2025
• Many immigration agents don’t even know this rule exists

👉 Don’t assume. Always check your school.

🛑 2. “I can switch from a student visa to a residence permit based on work”
Also NOT true.

If you are in Poland on a Polish student visa:
❌ you cannot simply apply for a temporary residence permit based on work (so-called Single Permit)
❌ such applications are a guaranteed refusal.

Sadly, some agents still submit these applications and take money - even though refusal is guaranteed.

🔍 How I work differently

I:
• follow changes already at the draft stage (before they enter into force)
• actively participate in submitting amendments to the laws (please check my other posts where I mention my proposals)
• don’t guess — I verify.

This is why I focus on prevention, not fixing problems after refusal.

📢 Изменения по спецзакону для граждан Украины: проект уже в Сейме и проходит ускоренную процедуру 🇺🇦🇵🇱

Проект закона, который заменяет так называемую «specustawę ukraińską», был официально направлен в Сейм 20 января.

Сегодня, 23 января, запланировано уже 2 (из 3) чтения проекта в Сейме.

Это означает, что работа над законом идёт в очень быстром темпе и финальные решения могут быть приняты до половины февраля (учитывая еще передачу к Сенат, вероятные сенатские поправки и т.д.).

📌 Важные изменения по работе

Напомню также о предложениях, которые были внесены Министерством труда и теперь находятся в проекте:
👉 граждане Украины без статуса UKR смогут ещё до 3 лет работать на основании уведомления о поручении работы (powiadomienie).

Благодаря этому:
👉 работодатели, ведущие деятельность в форме JDG, сохранят право нанимать граждан Украины (на основании powiadomieniа);
👉 будет решена проблема права на работу после 4 марта 2026 года для лиц, чьё пребывание продлено автоматически спецзаконом (в частности по безвизу).

ℹ️ Напоминаю: легальный статус пребывания не всегда означает право на работу, даже при наличии разрешения на работу. Именно поэтому эти изменения имеют такое практическое значение.

Я продолжаю следить за ходом проекта и сообщу о подписании Президентом окончательной версии.

⏳ Ждете карту побыту годами? Есть надежда на важные перемены! 🇪🇺🇵🇱

Легализация в Польше — это, пожалуй, самая сложная тема для многих из вас. Месяцы, а порой и годы ожидания решения («децизии»), невозможность планировать будущее и поездки...

Я прекрасно понимаю эту проблему, так как постоянно сталкиваюсь с ней в своей юридической практике, помогая иностранцам бороться с бюрократией.

Однако есть новости, которые могут изменить правила игры.

🏛 Что произошло?
Польский суд во Вроцлаве официально обратился в Суд Европейского Союза (по-польски TSUE или CJEU в английской версии) с прецедентным вопросом. Дело касается гражданки Украины, которая столкнулась с бесконечным затягиванием рассмотрения её дела в польском управлении (urząd).

❗️ Очень важная деталь: дело касается лиц со статусом UKR.
Запрос суда во Вроцлаве относится именно к ситуации людей, которые, имея статус временной защиты (UKR), подали заявление на вид на жительство (карту побыту) и столкнулись с бездействием или чрезмерными задержками со стороны администрации.

⚖️ О чем спросили Европейский суд?
Если перевести с юридического языка на простой: польский судья спрашивает у главного суда Евросоюза, допустимо ли, что вы ждете документы так долго? Не нарушает ли такая медлительность польских чиновников законы Евросоюза и ваши права?

🚀 Почему это важно для вас?
Если Суд ЕС в Люксембурге решит, что такие задержки в отношении обладателей статуса UKR незаконны, это создаст мощный прецедент. Польским властям придется искать способы ускорить работу ужендов и выдачу карт, чтобы соответствовать европейским нормам.

Это не произойдет завтра, но это первый серьезный шаг на международном уровне, чтобы заставить систему работать быстрее. Я буду внимательно следить за ответом из Люксембурга и информировать вас о ходе дела.
