Czy usługi podologa to jeszcze branża beauty, czy już świadczenia o charakterze zdrowotnym? To pytanie w praktyce okazuje się bardzo istotne dla VAT.
W najnowszym tekście dla serwisu Prawo.pl komentuję problem opodatkowania usług podologicznych, które znalazły się na styku kilku reżimów podatkowych: stawki 8% dla części usług kosmetycznych, zwolnienia z VAT dla usług medycznych oraz stawki podstawowej 23%.
Największy problem polega na tym, że podobnie wyglądający zabieg może być różnie traktowany w zależności od jego rzeczywistego celu, klasyfikacji usługi oraz statusu osoby wykonującej świadczenie.
Podologia nie jest więc wyłącznie częścią problemu branży beauty. To dobry przykład szerszego zjawiska: rosnącej liczby usług granicznych, które nie mieszczą się wygodnie w tradycyjnych kategoriach podatkowych.

Is podiatry still part of the beauty sector, or should it be treated as a health-related service?
For VAT purposes, this question is far from theoretical.
In the latest comment for Prawo.pl, I discuss the taxation of podiatry services, which sit at the intersection of several VAT regimes: the 8% rate for certain cosmetic services, VAT exemption for medical services, and the standard 23% rate.
The key difficulty is that a similar-looking treatment may be taxed differently depending on its actual purpose, the classification of the service, and the status of the person providing it.
Podiatry is therefore not merely another “beauty sector” issue. It is a good example of a broader problem: the growing number of borderline services that no longer fit comfortably into traditional tax categories.
