LEGALIZATION DURING THE PANDEMIC In this post we will talk about the specifics of the legalization process during the current pandemic.

📍 Automatic renewal of documents Now it is a unique time for legalization - during the pandemic, you are in Poland legally, even if your visa or card has expired + your stay is legal for another 30 days after the removal of the epidemic status in the country, provided that you have entered Poland before March 14th 2020. Work permits are extended in the same way.

📍 The deadline for submitting documents for the visit card has increased Due to the status of the epidemic in Poland, you can apply for a visit card, even if your visa is already expired, until the last day of the epidemic + 30 days after.

📍 In addition, the deadlines are shifting: - to leave the territory of Poland by foreigners in accordance with paragraph 6 of Article 299 of the Law "On Foreigners" of December 12, 2013. ("Legislative Bulletin" for 2020, p. 35); - to voluntary return to the homeland, prescribed in the decisions on the obligation of the foreigner to return in case of refusal after appeal; - to extend the validity of temporary identity cards of a foreigner issued to a foreigner applying for international protection.

WHAT DOES THE RED STAMP IN THE PASSPORT MEAN?

If you applied for a residence card and your fingerprints were taken, then there definitely is such a seal in your passport. This stamp confirms the submission of documents, the absence of formal errors in the application and the legality of the stay in Poland during the consideration of the case for obtaining a residence card.

It is important to note that the presence of the stamp and the absence of the visa affects the legality of your employment. You can continue to work if you already have a work permit or if you are classified as a person who does not need to receive permission. This category includes:
- graduates of Polish educational institutions;
- those who hold a humanitarian visa;
- owners of the pole card;
- scientific staff.

Is it possible to change jobs while staying in Poland on the basis of a seal?

Remember that the stamp in the passport does not give the right to enter Poland, as well as travel to EU countries. Therefore, when returning to your homeland, you will need to apply for a visa if you have no other grounds to enter Poland. Among these grounds may be:
- visa-free regime;
- other already valid visa.

The legal stay on the basis of the stamp in the passport ends after the decision on the case. If the decision is positive, then staying "on the seal" is legal until the card is received, and in case of a negative decision, staying is legal for the duration of the appeal. If the appeal is rejected, you can stay in Poland for no more than 30 days.

TYPES OF WORK PERMITS

What is this permission? A permit is a document that allows the foreigner to work legally, provided that the foreigner has a right for legal stay in Poland.

The following documents can act as a work permit:
- work permit from Urząd Pracy (oświadczenie o powierzeniu wykonywania pracy cudzoziemcowi);
- work permit from Wojewoda (zezwolenie na pracę typ A, B, C, E).

There are two types of permits in Poland:

1️⃣ Voivodeship permission

Everyone can get this permit if their stay in Poland is legal.

Place of issue: Voivodeship management.
Validity period: from one year up to 3 years.
Waiting period: 2-3 months.

2️⃣ Permission from the Labor Department

This type of permit can only be obtained by citizens of Ukraine, Russia, Belarus, Armenia, Georgia and Moldova.

Place of issue: Department of Labor.
Validity period: 24 months.
Waiting period: about a month, possibly faster.

Previously, this document was called oświadczenie o zamiarze powierzenia wykonywania pracy, and now it is oświadczenie o powierzeniu wykonywania pracy.

❗️ Do not confuse the types and names of permissions. The types include permissions A, B, C, D, E.

How to get a work permit?
Your employer has to apply for a work permit at the voivodeship administration at the place of the residence or the place of registration of the employer.

The list of required documents for obtaining each type of permit is different.

REFUGEE STATUS IN POLAND

Since the beginning of the war millions of people have already crossed the Polish border from Ukraine. Those who do not have an internal or foreign passport with them at the entrance are forced to ask for international protection, so now the topic of obtaining refugee status is more relevant than ever.

There are two options for applying for refugee status:

1. Submit an application at the Polish border to an employee of the Polish border services and explain the reason for leaving the country. If they indicate that they are afraid to return to their country of origin, the border authorities should allow them to apply for international protection.

2. An application for international protection may also be submitted by a foreigner who is already in Poland and who, during their stay, began to fear returning to their homeland.

When submitting an application, all available identity documents should be presented, as well as evidence that can confirm the basis for applying for such a status. If a foreigner has a valid travel document (passport), they must deposit it with the Head of the Department for Foreigners at the place of application.

After submitting an application for international protection, the foreigner is sent to a refugee reception center or, if the foreigner decides not to live in an open center, they can apply to the head of the Department for Foreigners for funds for independent living outside the center.

It is important to note that a foreigner applying for international protection is legally located on the territory of Poland. However, they cannot cross the Polish border and leave Poland.

Remember, in the conditions of war in Ukraine, you can cross the border and apply without any identity documents!

The procedure for granting international protection under the current regulations lasts up to 6 months. However, the average waiting time for a decision is 14.5 months.

A foreigner cannot work during the first 6 months of the procedure.

THE RESIDENCE CARD ON THE BASIS OF STUDYING IN A POST-SECONDARY SCHOOL

We have already written earlier about why it is worth being a student of a post-secondary school. And today we will tell you about a possible way of legalization based on studying at these educational institutions.

Studying at a post-secondary school allows you to aquire a type D national visa. When you come to Poland, you can immediately apply for a stay card based on your studies.

You can apply for this type of temporary residence card, if there are 3 or more months left before your graduation from the post-secondary school. The period for which such a card will be issued is a year at minimum and at maximum one and a half.

Important points:
📍 You can apply for a card by studying both in the person and online, as long as the number of hours meets the requirements for obtaining a card.
📍 Subject to a 2-year period of study, the first card will be issued for 1 year of study + 3 months, provided that the documents for the card are promptly submitted immediately after admission.

Let's look at the advantages and disadvantages of getting such a card:
+ gives the right to work with a work permit;
+ lack of binding to the employer;
- stay in the country on this type of card is counted only for half of the actual stay period in the calculation of stay on the card of a long-term resident of the EU;
- lack of ability to work without a work permit;

CERTIFICATE OF KNOWLEDGE OF THE POLISH LANGUAGE FOR THE RESIDENCE CARD

Perhaps you haven't thought about getting a certificate of knowledge of the Polish language, and you don't even realize that you need it. If you decide to stay in Poland for a longer period of time, then you will definitely need to obtain such a certificate. In this article, we will figure out who and when needs to take care of obtaining a certificate, how much it costs and where you can take the exam.

The certificate is required to fulfill a formal requirement in the process of legalization and admission to Polish universities.

WHO should receive a certificate of language proficiency:
1. Those who wish to receive a resident card - level B1;
2. Those wishing to obtain citizenship - level B1;
3. Those who are applying for universities.

Not all universities require a certificate of state-standard language proficiency. When enrolling in some private universities, you can do with obtaining certificate after completing your courses.

The price of obtaining a certificate depends on the level at which you take the exam.
• 90 € – A1-B2;
• 120 € – A1, A2;
• 150 € – B1, B2;
• 180 € – C1, C2;

Payment for the issuance of the certificate is 20 euros paid in its equivalent in złoty.

Yes, the exam is not cheap, so we recommend that you prepare in advance and pass all the test tasks, which can be downloaded on the commission page. In addition to the high price for passing the exam, there is another problem - it is not easy to sign up for it. On the website of the organization where you plan to take the exam, information about the possibility for signing up will appear 3-4 months before the exam’s date. There are a lot of people who want to sign up, so it's better to keep the track of the appearance of any new information. However, this issue will not affect everyone: some persons are exempt from taking the exam.

WHO can be exempted from passing the state exam:
- graduates of Polish higher educational institutions;
- graduates of post-secondary schools;
- graduates of Polish high schools or technical schools.

ZUS or Zakład Ubezpiczeń Społecznych is a state social insurance authority in Poland.

It is very important to understand the basics of social insurance in Poland in order to know your rights and understand what deductions you pay from income and what you can count on in an event that is covered by your insurance.

So, let's look at the main issues.

🖍 WHO pays contributions to ZUS?
Entrepreneurs, partners, self-employed and salaried employees.
Remember that if you are a student of any school under the age of 26, then you do not pay contributions to ZUS. That means your brutto salary is your netto one. However, you can apply for voluntary insurance.

🖍 WHAT are the contributions?
There are contributions that the employer pays for the employee and contributions that the employee pays for themself.

Types of contributions that an employee pays from their income to ZUS:
- pension;
- disability insurance that guarantees cash benefits in case of loss of monetary income associated with the occurrence of disability risk;
- medical insurance.

Contributions paid by the employer:
- health insurance;
- accident insurance;
- contribution to the labor fund;
- Contribution to FGŚP (Guaranteed Employee Benefits Fund);
- pension;
- disability insurance.

HOW are contributions paid according to the type of employment contract?

1 On Umowa o pracę - the employer pays all social contributions.
2 On Umowa zlecenie - the employer pays all social contributions, except for insurance in case of illness.
3 On Umowa o dzieło - it is necessary to make social insurance contributions personally.

You can always check the amount of contributions that the employer pays for you on the website zus.pl in your personal account.

As for the visit card, here is a list of documents that you may need to issue a visit card:
1. Zaświadczenie o niezaległości pracodawcy przed ZUS - this document will be issued to you by the employer upon request;

According to the publication in Rrzeczpospolita, about 18.3 thousand citizens received the Poland Business Harbour visa in 2021.

EKUZ CARD FROM NFZ. WHAT IS IT AND HOW TO GET IT

If you actively use the benefits of having a Schengen visa and often travel to other European countries, the EKUZ card is something that will be useful for you. And it is issued absolutely free of charge 😉

EKUZ (Europejska Karta Ubezpieczenia Zdrowotnego) is a document that confirms your right to free treatment in EU countries.

As an EKUZ card holder, you can count on:
- necessary and unplanned free treatment;
- treatment within the framework of the state health system of the state you are currently in;
- treatment on the same principles used by citizens of a given EU country (for example, if a state obliges its citizens to pay part of the costs of visiting a doctor, then you will pay it).

There are some territorial exceptions that are not covered by the EKUZ card. For example, if you are not a Polish citizen, then your card does not apply in the following EU states: Iceland, Norway, Liechtenstein, Switzerland and Denmark.

WHO can get such a card:
- insured persons in Poland (working on umowa o pracę or retired people);
- uninsured persons who are eligible for treatment (for example, children under 18 who cannot be registered for insurance by a parent or grandparent).

WHERE to get it:
- in the NFZ department;
- via email;
- via ePUAP;
- via IKP (Internetowe Konto Pacjenta);
- through traditional mail.

WHAT you need to get it:
- student ID card;
- if you work in Poland, no documents will be required, you will only be checked for payment of contributions to ZUS;
- A1 document issued by ZUS/KRUS if you are leaving Poland in connection with work;
- U2 document issued by the Department of Labor (Urząd Pracy) if you are traveling to another EU country in order to find a job.

The EKUZ card is an excellent solution for active residents of Europe. Thanks to it, you can travel without worrying about insurance on the territories of European countries. Travel safely!
