Every now and then I have a client who was given a choice of B2B or a contract of employment and chose B2B because he will earn more. And after coming to me, he finds out that he has lost several or sometimes tens of thousands of zlotys. HR managers are stubbornly giving lower rates on B2B because they do not know how or do not want to calculate them correctly from a full-time job.

That is why I have prepared a ‘short’ text on how to do this correctly so as not to lose money, along with an explanation of the entire process so that it can be explained to the ‘client’.

✒ Is it worth to apply for a qualified electronic signature (QES)?

🔻 In some situations a simple electronic signature (e.g. with a stylus) may not be sufficient, because it can be easily undermined or the law requires a different type of signature.

🔻 While a simple electronic signature is ok in many situations, some cases require a qualified signature. It allows you to use it in IT contracts with copyright, for example.

If you are planning to electronic authorization:

🔘 business contracts
🔘 reports to eKRS,
🔘 participation in and tenders, etc.,

☑ it is recommended to obtain a qualified electronic signature.

🇺🇦 Ukrainians are now able to set up sole proprietorships on the same conditions as Polish citizens. 🇵🇱

To be able to do that, you first need to obtain a PESEL number.

To set up your own business (sole proprietorship):
• go to city or municipal office,
• confirm your identity and fill in the application form prepared by the official.

☑ You can also do it via Internet on https://www.biznes.gov.pl/pl/e-uslugi/00_0736_00.

In order to do so, you should:
• set up a portal account,
• fill in the application form,
• sign it using the e-PUAP trusted profile.

In case of foreigners it will take about three working days to register your business ⏱

People legally present in Poland can be employed without a work permit ☑

Your employer only needs to notify a county (powiat) labour office within 14 days of your assignment to a position. ☑

In order to do that you need to provide the following information:
🔘 name and surname,
🔘 date of birth,
🔘 s*x,
🔘 citizenship,
🔘 type, number and series of an identity document confirming your identity and the country of issue.

Make sure your employer also includes the following data in the document:
🔘 identification data of the company,
🔘 the type of employment contract,
🔘 your position or type of work performed,
🔘 the location of the work performed.

Your employer should send the notification through praca.gov.pl portal. ☑

There is a phenomenon called Talent Gap, which significantly impacts the job market for IT 🖥️ and others like highly specialized lawyers.

Most of the companies are focused on bringing experienced candidates for a job, which makes them all competing for the same pool of experts and raises salaries. 📈

Because of that and limitations related with scale of their activities, some IT companies decided to utilize unorthodox solutions. They look for candidates which fit in within their team because of their personality and are easy to learn necessary skills. 🧒

📖 SLA stands for Service Level Agreement and is an agreement used to secure the minimum level of various IT services.

Such contract serves as a basic measure to secure companies buying cloud computing, Internet access, suport (e.g. helpdesk) or hardware maintenance servicing. This way companies may reduce risks of downtime in their business. ☁️

Well drafted SLA addresses:
♦️ required level of availability - the percentage of time when the service shall be accessible and/or operatible within a given year, month or day. The higher the better but also the more expensive SLA.
♦️ time of availability or maintenance break time;
♦️ monitoring and reporting process - way of collecting and sharing services statistics;
♦️ how to report incidents/problems - contact data, helpdesk working hours;
♦️ reaction time - how quickly issues shall be resolved.
