When filling out your application (wniosek), write this word-for-word in the podstawa prawna (legal basis) section:

⚖️ Art. 20ad i 20c ustawy z dnia 17 lutego 2005 r. o informatyzacji działalności podmiotów realizujących zadania publiczne (Dz. U. z 2024 r. poz. 307 ze zm.) — w sprawie profilu zaufanego i podpisu zaufanego.

What this means:
You are legally requesting a PESEL to set up a Profil Zaufany (digital signature) for online communication with the state (crucial for the MOS platform). They have no right to deny you this.
