The Hon’ble President of the Peshawar High Court (Mingora Bench) Bar Association, Mr. Razauddin Khan, Advocate Supreme Court, has expressed his profound grief and sorrow over the tragic roof collapse at Al-Khair School in Afridi Abad, Peshawar, which claimed the precious lives of 30 innocent students and a female teacher and left several others injured.

The Hon’ble President termed the incident an extremely heartbreaking tragedy and extended his deepest condolences and heartfelt sympathies to the bereaved families. He stated that the loss of innocent young lives in a place of learning is an irreparable loss not only for the affected families but for the entire nation. He also prayed for the eternal peace of the departed souls, strength and patience for the grieving families, and the speedy and complete recovery of the injured.

Mr. Razauddin Khan emphasized that the safety of children in educational institutions must be treated as a fundamental responsibility. He stressed that a transparent, impartial, and comprehensive investigation must be conducted to determine the actual causes of the collapse and fix responsibility upon all persons and authorities whose negligence or failure to discharge their legal duties contributed to this tragic incident.

He further called upon the relevant authorities to ensure immediate structural safety audits of all public and private educational institutions, strictly enforce building codes and safety regulations, and take effective preventive measures to ensure that such heartbreaking incidents do not recur.

The Hon’ble President observed that no parent should ever have to endure the unbearable pain of losing a child while sending them to school to receive an education. He urged the authorities to provide the best possible medical care to the injured and adequate assistance and compensation to the bereaved families in accordance with the law.

The Peshawar High Court (Mingora Bench) Bar Association stands in solidarity with the affected families in this hour of profound grief and calls for accountability, effective enforcement of safety standards, and concrete measures to safeguard the lives of students and teachers across the country.

STRIKE NOTICE

All respected members of the Peshawar High Court, Mingora Bench Bar Association, are hereby informed that, in consultation with the members of the Khyber Pakhtunkhwa Bar Council representing Malakand Division, the Cabinet has decided to observe a complete court boycott on Tuesday, 13 October 2026, across Malakand Division in protest against the imposition of Governor’s Rule and the declaration of an emergency in the Province of Khyber Pakhtunkhwa.

The Cabinet expresses serious concern over these developments and their potential implications for provincial autonomy, constitutional principles, democratic values, and the people’s right to self-governance.

All members are requested to fully observe the strike and refrain from appearing before the courts on the aforementioned date.

CONDEMNATION STATEMENT

Hon’ble Mr. Razauddin Khan, Advocate Supreme Court, President, Peshawar High Court (Mingora Bench) Bar Association, strongly condemns the grave incident of firing and intimidation at the residence of the Association’s esteemed member, Mr. Alamgir Khan, Advocate High Court, Wari, District Upper Dir.

The incident is a serious threat to the life, security, dignity and professional independence of a member of the legal fraternity. The attempt to intimidate and obstruct a lawyer in the discharge of his professional responsibilities is highly regrettable and strongly condemnable.

The Peshawar High Court, (Mingora Bench) Bar Association calls upon the concerned law-enforcement authorities and the administration to ensure the immediate and adequate security of Hon'ble Mr. Alamgir Khan, Advocate High Court, and his family, and to take prompt and impartial action in accordance with law so that the accused are brought to justice.

The Association stands firmly with its esteemed member and expects the concerned authorities to ensure that no lawyer is intimidated, threatened, or obstructed from performing his lawful professional duties.

UNANIMOUS RESOLUTION
Peshawar High Court, Mingora Bench Bar Association
General Body Meeting — Dated: 05 October 2026
The General Body Meeting of the Peshawar High Court, Mingora Bench Bar Association was held under the chairmanship of Mr. Raza-Ud-Din Khan, Advocate Supreme Court, President, Peshawar High Court, Mingora Bench Bar Association. The meeting was attended by the Hon’ble Members of the Khyber Pakhtunkhwa Bar Council from Malakand Division, Hon’ble Presidents and General Secretaries of the District and Tehsil Bar Associations, and senior members of the legal fraternity.
The General Body thoroughly deliberated upon the notice/communication issued by the Additional Registrar, Peshawar High Court, Mingora Bench, including the language and tenor thereof, the various allegations and objections contained therein, the ongoing/proposed excavation and leveling work on the land owned by the Peshawar High Court, Mingora Bench Bar Association, as well as the conduct and attitude of the Additional Registrar in relation to the matter.
After due deliberation, the General Body unanimously expressed its serious concern and unequivocally condemned the contents, language and tenor of the said notice/communication, the allegations and objections raised therein, as well as the conduct and attitude of the Additional Registrar, and observed that such conduct is inappropriate and inconsistent with the dignity, institutional respect and standing of the Peshawar High Court, Mingora Bench Bar Association.
The General Body, while upholding the dignity of the legal profession and the institutional relationship and mutual respect between the Bar and the Bench, resolved that the matter should first be pursued through meaningful dialogue, mutual respect, consultation and amicable resolution.
Accordingly, it was unanimously resolved that the Cabinet of the Peshawar High Court, Mingora Bench Bar Association, accompanied by senior members, shall meet the Hon’ble Senior Administrative Judge, Peshawar High Court, Mingora Bench, and place before His Lordship the complete facts, concerns and position of the Bar Association, with a view to seeking an appropriate, fair and dignified resolution of the matter.
The General Body, however, unequivocally resolves that, If the matter not be resolved through meaningful dialogue, consultation and mutual understanding, the Peshawar High Court, Mingora Bench Bar Association shall determine its future course of action and shall reserve its full right to take all appropriate, effective and lawful measures for the protection of its constitutional and legal rights, institutional dignity and legitimate interests.
The above resolution was unanimously adopted by the General Body.

PESHAWAR HIGH COURT, MINGORA BENCH BAR ASSOCIATION

GENERAL BODY MEETING NOTICE

The Hon'ble former President of the Peshawar High Court, Mingora Bench Bar Association, Mr. Abdul Haleem, Advocate Supreme Court purchased one Kanal of land near the Peshawar High Court, Mingora Bench, for the Bar Association and transferred the same in the name of the Bar Association through a registered deed.

Since the said land was hilly and uneven, excavation and levelling of the site was necessary before construction of any building. For this purpose, an excavator was used for approximately two days to break the stones and level the land. However, due to the hard nature of the mountain, further excavation was likely to require considerable time and financial resources.

Accordingly, the proposal for blasting through a drilling machine was considered for completing the excavation and levelling work. The concerned persons informed the Bar Association that the blasting would be carried out with necessary precautionary and safety measures and that appropriate measures would be taken to prevent any loss of life or damage to nearby buildings.

“It is further clarified that the proposed blasting work was to be carried out through a duly authorized and licensed blaster/explosives operator, holding a valid licence issued by the competent authority, and strictly in accordance with all applicable laws, rules, permissions and prescribed safety requirements.”

In this regard, the Hon'ble President of the Bar Association, Mr. Razauddin Khan, Advocate Supreme Court, also contacted the Deputy Commissioner, Swat, by telephone, who assured him of all possible cooperation. A meeting was also held with the Additional Registrar, Peshawar High Court, Mingora Bench, regarding the matter.

Subsequently, a notice was issued to the Bar Association by the Additional Registrar, Peshawar High Court, Mingora Bench, concerning the aforesaid activity, raising various matters relating to the excavation/levelling work, alleged use of explosive material, requisite permissions, environmental clearance and safety measures.

In view of the said notice, this General Body Meeting has been convened so that all relevant facts may be placed before the General Body, the views of the members may be heard, the legal and administrative aspects of the matter may be considered, and the future course of action of the Bar Association may be determined.

Serious Concern Over Civil Judge Examination Results

The Hon’ble President of the Peshawar High Court Mingora Bench Bar Association, Mr. Razauddin Khan, Advocate Supreme Court, has expressed serious concern over the results announced by the Khyber Pakhtunkhwa Public Service Commission (KPPSC) for the recruitment of 105 Civil Judge-cum-Judicial Magistrate/Alaka Qazi (BPS-18).

As per the KPPSC announcement, 3,097 applications were received and 1,024 candidates appeared in the written examination, but only three candidates were declared successful.

The Hon’ble President has called upon the Hon’ble Chief Justice of the Peshawar High Court to take immediate notice of the matter and ensure a comprehensive review of the examination process, criteria and results in the interest of fairness and transparency.

He further emphasized that, in view of the shortage of judicial officers and the increasing backlog of cases, vacant judicial posts must be filled expeditiously through a transparent, fair and credible mechanism.

The Association also calls for reconsideration of the existing recruitment mechanism and supports an appropriate role for the Peshawar High Court in the recruitment of Civil Judges, including consideration of experienced, qualified and competent advocates with substantial legal practice, subject to the relevant constitutional and legal framework.

The Association reiterates that an effective judicial recruitment system is essential for strengthening the administration of justice and ensuring timely access to justice for the public.
