خلع کی ڈگری فیملی کورٹ سے جاری ہونے کے بعد بھی قانونی طور پر طلاق اس وقت مکمل اور مؤثر سمجھی جاتی ہے جب یونین کونسل سے باقاعدہ طلاق سرٹیفکیٹ جاری ہو جائے۔ خلع ڈگری ملنے کے بعد عدالت کے فیصلے کی مصدقہ نقل متعلقہ یونین کونسل میں جمع کروائی جاتی ہے، جہاں سے شوہر کو نوٹس جاری کیا جاتا ہے۔ مقررہ قانونی مدت (90 دن) مکمل ہونے کے بعد یونین کونسل طلاق مؤثر ہونے کا سرٹیفکیٹ جاری کرتی ہے۔ اس طلاق سرٹیفکیٹ کی بنیاد پر خاتون اپنے شناختی کارڈ، نادرا ریکارڈ، پاسپورٹ اور دیگر سرکاری دستاویزات میں شوہر کا نام ختم کروا کر والد کے نام پر تصحیح کروا سکتی ہے۔ خلع کی ڈگری کے بغیر یا یونین کونسل کے سرٹیفکیٹ کے بغیر طلاق قانونی طور پر مکمل تصور نہیں ہوتی، اس لیے درست اور قانونی طریقہ اختیار کرنا بے حد ضروری ہے۔

After the Khula decree is granted by the Family Court, the divorce becomes legally effective only when a Divorce Certificate is issued by the Union Council. Upon receiving the Khula decree, a certified copy of the court order is submitted to the concerned Union Council, which then issues a notice to the husband. After completion of the mandatory legal period of 90 days, the Union Council issues the effective Divorce Certificate. On the basis of this certificate, the woman can update her CNIC, NADRA record, passport, and other official documents by removing the husband’s name and restoring her father’s name. Without the Union Council’s Divorce Certificate, the divorce is not considered legally complete; therefore, following the proper legal procedure is essential.

JUDGEMENT.
Punjab Protection of Ownership of Immoveable Property Ordinance, 2025.
ڈی آر سی کو قبضہ واپس کرانے کا کوئی قانونی اختیار حاصل نہ ہے۔

The Dispute Resolution Committee (DRC) is a pre-adjudicatory, fact-finding and facilitative body and has no jurisdiction to order eviction, dispossession, or restoration of possession.
Coercive or executory (naeem)measures affecting possession can only be undertaken by the Tribunal under Sections 16 and 17 of the Ordinance.
Preventive powers under Section 9 are limited, temporary, and must be exercised through written, reasoned orders after hearing the parties.
While exercising powers under Section 9, the DRC(naeem) must strictly adhere to any subsisting status-quo order of a competent court, and shall not pass any preventive order in conflict therewith.

Any oral or coercive direction by the DRC or its members is without lawful authority and violative of due process of law.

ہائیکورٹ نے قرار دیا استقرارحق کا دعوی بغیر قبضے کے نہیں مانگا جا سکتا اور اگر قبضہ پاس نہ تو استقرار حق کے ساتھ قبضہ کا کیس بھی ساتھ کرنا لازمی ہے۔ درخواست گزار نے خود تسلیم کیا کہ زمین پر قبضہ مدعا علیہان کے پاس ہے تو صرف "ملکیت کا اعلان " نہیں مانگا جا سکتا جب تک کے قبضہ کی بحالی کی درخواست نہ کی جائے ۔۔۔۔۔۔
