Sindh High Court rules that law which allows foreign wives of Pakistani nationals citizenship but doesn’t extend to foreign husbands of Pakistani nationals is clearly discriminatory - it allowed petitions from five Pakistan mi women who had said that their foreign husbands had not been given citizenship under this law

Three of the petitions were filed in 1996, and one in 2014 and in 2021

PECA 2016 (introduced by PML-N, necessary reminder) is still there. An amended Section 20 also still exists however with the reversal of the ordinance, it is once again a non-cognizable offence - the FIA cannot act on its own - and only an aggrieved party can be the complainant.

There are only 3 cognizable offences in PECA, Sections 10, 21 and 22. Other than these, all are non-cognizable, a complaint is required and the magistrate's permission to initiate action, FIA is not permitted to act on its own or at anyone's behest. In practice, this is different.

Any "legal" action will require following procedure as laid down in the law. In practice, this is not done, especially when crackdowns become imminent due to a political climate and situation. These are then addressed after, as we've seen in the cases of various journalists. Nothing in the law currently permits any institution, or department to be an informant or complainant, which is the change made by the PTI ordinance with respect to S.20. Had the ordinance remained, it would be open season & immediate arrests for hashtag warriors & angry supporters

Whether we are actually on a democratic path, time will tell. IHC order is great, but other sections in PECA remain. If extra-legal measures remain the order of the day & manipulation of PECA together with PPC, ATA, MPO & other laws continue, rest assured there is no rule of law.

نادرا حکام کے مطابق یہ اقدام بچوں کو منفی معاشرتی رویوں سے بچانے کے لیے کیا جا رہا ہے۔

بی بی سی سے گفتگو کرتے ہوئے چیئرمین نادرا طارق ملک نے اس فیصلے کے حوالے سے بتایا کہ اس کا مقصد یہ ہے کہ سنگل پیرنٹ (اکیلی مائیں) یعنی جس کا شوہر نہیں، طلاق ہو گئی یا علیحدگی ہو گئی ہے یا والد نے بچے کو اپنایا نہیں تو ان کے بچوں کی رجسٹریشن میں آسانی پیدا کی جائے۔

یعنی اب وہ خواتین جو ریپ کا شکار ہوتی ہیں یا جن کے بچوں کے والد انھیں چھوڑ کر چلے جاتے ہیں یا لاتعلقی اختیار کرتے ہیں ان کے بچوں کے لیے اپنے شناختی دستاویزات بنانے میں کوئی مشکل نہیں ہو گی۔

نادرا کے سسٹم میں اگر والد کا نام نہ ہو تو انٹری مکمل تصور نہیں کی جاتی اور پراسیس مکمل نہ ہونے کی وجہ سے شناختی دستاویز بھی نہیں بن سکتی۔

صدر عارف علوی نے آئین کے آرٹیکل 89 کے تحت تحفظ والدین آرڈیننس 2021 جاری کردیا۔

آرڈیننس کا مقصد بچوں کی جانب سے والدین کو زبردستی گھروں سے نکالنے کے خلاف تحفظ فراہم کرنا ہے۔

آرڈیننس کے تحت والدین کو گھروں سے نکالنا قابل سزا جرم ہوگا۔

والدین کو گھروں سے نکالنے پر ایک سال تک قید، جرمانہ یا دونوں سزائیں دی جائیں گی۔

گھر بچوں کی ملکیت ہونے یا کرائے پر ہونے کی صورت میں بھی بھی والدین کو نہیں نکالا جاسکے گا۔

گھر والدین کی ملکیت ہونے کی صورت میں والدین کو بچوں کو گھر سے نکالنے کا اختیار ہوگا۔

والدین کے بچوں کو تحریری نوٹس دینے کی صورت میں گھر خالی کرنا لازمی ہوگا۔

وقت پر گھر خالی نہ کرنے کی صورت میں 30 دن تک جیل، جرمانہ یا دونوں سزاؤں کا اطلاق ہوگا۔

بچوں کی جانب سے گھر نہ چھوڑنے کی صورت ضلعی ڈپٹی کمشنر کو کاروائی کا اختیار ہوگا۔

ضلعی ڈپٹی کمشنر والدین کی جانب سے شکایت پر کاروائی کا مجاز ہوگا۔

والدین کی جانب سے شکایت موصول ہونے پر پولیس کو بغیر وارنٹ گرفتاری کا اختیار ہوگا۔

آرڈیننس کے تحت گرفتار افراد کو مجسٹریٹ کے سامنے پیش کیا جائے گا۔

آرڈیننس کے تحت والدین اور بچوں کو اپیل کا حق حاصل ہوگا۔
