An article written by our partner Barrister Asad-ul-Mulk on the 27th Amendment, the potential shifting of the ‘grundnorm’, the ‘basic structure doctrine’ and challenge posed to the rule of law and separation of powers.

The amendment came against a dubious backdrop.

“The issue of the nature and scope of amendment powers raises important questions. Are there any constitutional principles so fundamental that they carry a supra-constitutional status, in the sense that they cannot be amended? Does a radical constitutional change brought about through an amendment cease to be ‘an amendment’ and become a constitutional revolution or a legal
coup d’état? What can and should courts do when they face a fait accompli in the form of such an amendment?”

“A proceduralist might claim that a ‘revolution’ only requires a change to or a replacement of the constitution in a way that is incompatible with the amendment procedure, as understood by Hans Kelsen. A substantivist might claim that a revolutionary change can also occur through legal means.”

An article written by our partner Barrister Asad-ul-Mulk regarding litigants non-grata or vexatious litigants. The article briefly touches upon how the judicial apparatus, given its rigours, protracted procedures, and extensive appeal processes, is particularly susceptible to abuse. And why there is a need to do more to discourage vexatious litigants.

Use of admonishing language isn’t enough.

Overview

Legal Parameter is a law chamber, set up by Mr Asad Ul Mulk (who happens to be a barrister) to provide litigation and advisory services across a diverse area of law. The aim of the chamber is to place on offer quality services, without compromising on professional ethics. An additional, yet integral, aim of the chamber is to pursue public interest litigation and provide free legal services to the most destitute segment of the community.

The chamber endeavours to cater not only to the needs of the corporate and commercial sector but to common litigants as well. The founder of the chamber, Mr Ul Mulk (inter-alia) in the pursuit of his own property cases has been instilled with realisation of the full magnitude of the painful and generational nature of litigation in Pakistan, an experience which has harboured both empathy and understanding. While the protracted nature of litigation in the country cannot be expunged without pervasive reforms in the justice system - through the adoption of a professional approach and recourse to innovative legal solutions, the agony can certainly be alleviated, even today.

Legal Parameter in founded upon the conviction that; because an agreement between a client and a lawyer involves understanding, with the former reposing trust in the latter, the element of sacredness in the arrangement is undeniable. We pledge, to honour and accredit the trust you place in our hands.
