After reviewing the arguments and examining the evidence, the bench held that the prosecution had failed to prove the charge beyond reasonable doubt. The court observed that such glaring contradictions entitled the accused to benefit of doubt.

The Peshawar High Court has sought a detailed response from the Khyber Pakhtunkhwa government over its failure to implement the Legal Aid Act, 2019. A two-member bench comprising Justice Ejaz Anwar and Justice Muhammad Naeem Anwar heard the petition.

Advocate Nouman Muhib Kakakhel, representing the petitioner, argued that the province was required to establish a Legal Aid Agency for individuals who cannot afford legal representation, but even after six years no steps have been taken to enforce the Act. He submitted that under this law, prisoners and women involved in domestic disputes are entitled to free legal assistance, and the government is responsible for paying lawyers’ fees in such cases.

The bench questioned in which matters the government is obligated to provide free counsel. Advocate Kakakhel clarified that the obligation applies to cases involving prisoners and women facing domestic issues.

The court then issued notices to the Chief Secretary and the Secretary Law, directing them to submit detailed replies, and adjourned the hearing.

Peshawar High Court Reinstates Medrect Hospital in Sehat Card Program

In a major relief, the Peshawar High Court (Mingora Bench) has suspended the delisting of Medrect International Hospital, Timergara from the Sehat Sahulat Program, allowing it to operate as a panel hospital until final decision.

Filed by Advocate Nouman Muhib Kakakhel, the petition argued that the removal was abrupt, without due process, and violated fundamental rights under Articles 4, 10-A, 18, and 25 of the Constitution. The Court observed that no proper hearing or evidence was provided, and the action was disproportionate and discriminatory—especially when similar hospitals were granted relief.

The stay order ensures continued healthcare access for thousands of patients in the Dir region.
