Regarding the Netherlands-Pakistan international tax treaty, this ruling is rather confusing. The majority decision has studied the Netherlands-Pakistan double taxation agreement, evaluated various international tax rules, and examined whether or not royalties are taxed. The dissenting opinion of Justice Mansoor Ali Shah is also quite intriguing since it focuses on whether or not royalties are taxable under the Income Tax Ordinance rather than whether or not treaties are justiciable. This is in contrast to the majority judgement, which focused on the treaty law's technicalities while posing a number of open-ended concerns.
