The Question Every Client Should Ask Their Lawyer
Most clients ask their lawyer:
Can we win this case?
It is a fair question.
But, in my experience, there is another question that is often far more important:
What can go wrong?
A good lawyer should not only tell you about your chances of success.
They should also identify:
i. The weaknesses in your case;
ii. The risks you may not have considered;
iii. The evidence you may be missing;
iv. The time and cost involved;
v. The possible consequences of losing; and
vi. Whether litigation is even the best option
Sometimes, the best legal advice is not:
Yes, we should go to court.
Sometimes it is:
Let's think about this carefully before we go to court.
Clients deserve honest advice, even when that advice is not what they want to hear. Because the role of a lawyer is not merely to fight for a client. It is also to help the client make a better-informed decision.
Should a lawyer always tell a client what they want to hear, or what they need to hear?
