Lahore High Court has conditionally suspended the trial court’s order directing Meesha Shafi to pay Rs5 million in damages to Ali Zafar in a defamation case.

The court granted interim relief by suspending the damages, subject to deposit of Rs2.5 million in cash and a surety bond for the remaining amount.

However, the restriction on repeating harassment allegations against Ali Zafar will remain in force. The court has also issued notice and adjourned the hearing.

Islamabad High Court has upheld the cancellation of the lease for the One Constitution Avenue project.

The court has ruled that buyers of apartments in the project do not have ownership rights. However, they may pursue legal remedies against the builder for recovery of their investment.

The judgment also dismissed petitions filed by the developer and other stakeholders challenging the CDA’s decision.

Not everyone has the right to challenge an acquittal.

The Lahore High Court has reaffirmed that a person who is neither the complainant nor an aggrieved party has no locus standi to file a criminal revision.

Where the law provides a specific procedure, it must be followed. A private individual cannot step in where the State chooses not to appeal.

Also a reminder: revision cannot be used as a substitute for appeal.

An Additional District and Sessions Court has convicted a man under the law of Qazaf and sentenced him to 80 lashes for falsely accusing his former wife of adultery.

Additional District and Sessions Judge Rana Khalil Ahmad Khan awarded the sentence to the convict, Muhammad Boota, after finding him guilty of making false allegations of zina (adultery). He had accused his former wife of maintaining illicit relations with strangers, alleged that she gave birth to an illegitimate baby girl, and claimed that the child was not his.

The convict’s former wife had initially filed a complaint under Qazaf before a local magistrate; however, the complaint was dismissed at the preliminary stage after initial arguments.
