Can a pending criminal case stop you from getting a Character Certificate?

A criminal case is not the same as a conviction. The legal position regarding Character Certificates was examined by the Peshawar High Court in PLD 2026 Peshawar 67.

FIR darj karwate waqt ye ghaltiyan mat kijiye ⚖️

FIR criminal case ki bunyaad hoti hai. Waqia ke waqt maujood gawahon ka zikr, relevant crime-scene evidence aur basic facts ko accurately record karwana baad ki legal proceedings mein bohat important ho sakta hai.

📌 Important legal points:
• Gawahon ki presence aur unke naam ka relevant mention
• Empties / cartridges jaisi relevant evidence ki detail
• Tattima bayan FIR ka replacement nahi
• Agar consultation se FIR ki spontaneity questionable prove ho, to uski credibility aur evidentiary worth judicial scrutiny mein aa sakti hai.

Kya kisi foreign national ka case Pakistan mein pending ho to kya usay Pakistan mein rehne ka automatic haq mil jata hai?

Peshawar High Court ne wazeh kiya ke sirf civil ya criminal case pending hone ki wajah se kisi foreign national ko Pakistan mein ghair-muayyana muddat tak rehne ka automatic legal right hasil nahi hota.

Foreign national ka Pakistan mein qiyam Immigration Laws aur Federal Government ki nafiz policy ke taabe hota hai.

Agar woh apne pending cases ki pairvi ke liye Pakistan mein rehna chahta hai, to woh Competent Authority se Visa ya qiyam ki kisi doosri legal permission ke liye application de sakta hai.

⚖️ 6 mahine se zyada purana cheque bounce ho jaye — kya 489-F PPC ki FIR ho sakti hai?

Har surat mein nahi.

2021 P Cr. L J 1071 mein Lahore High Court ne clarify kiya ke Section 489-F PPC mein cheque present karne ki koi fixed statutory time-limit nahi, lekin cheque reasonable time mein present hona chahiye.

Banking practice mein 6 mahine se zyada purana cheque generally stale cheque consider ho sakta hai. Is case mein cheque taqreeban 1 saal 6 mahine baad present hua, aur Court ne stale cheque ki bunyaad par criminal proceedings ko sustainable nahi mana.

📌 Important: Sirf cheque dishonour hona kafi nahi. Section 489-F PPC ke tamam legal elements establish hona zaroori hain.

Nikahnama mein likhi hui property agar baad mein wife ko transfer na ho sake, to kya Haq-e-Mahr khatam ho jata hai? ⚖️

Supreme Court of Pakistan ke 22 September 2026 ke judgment ke mutabiq, sirf property transfer na hone se wife ka Haq-e-Mahr khatam nahi hota.

Mahr sirf cash tak limited nahi. Money, gold, jewellery, movable ya immovable property aur koi bhi lawful asset of value Mahr ho sakta hai.

Agar property Mahr mein di gayi ho aur transfer na ho sake, to husband ki Mahr ki liability barqarar reh sakti hai. Agreed value available ho to usay consider kiya ja sakta hai, aur value record na ho to Court market value determine kar sakti hai.

Nikahnama ki Columns 13–16 ko bhi baahmi taur par read kiya jayega.

Kya ICC ke Anti-Corruption rules ki wajah se NCCIA ki criminal inquiry ruk sakti hai?

Lahore High Court ke is faislay mein ek important legal distinction samne aati hai: ICC ka Anti-Corruption Code apna disciplinary framework hai, jabke State ki criminal inquiry apne legal framework ke tehat chal sakti hai.

Court ne petition dismiss karte hue yeh bhi direct kiya ke inquiry ke dauran concerned person ko harass ya bila-wajah inconvenience na kiya jaye.

Kya murder case mein police, court se bail liye baghair mulzim ko muchalkon par release kar sakti hai?

Section 169 Cr.P.C. ke tehat, agar investigation ke dauran police ko filhal kafi legal evidence na mile, to mulzim ko bond/muchalkon par temporary release kiya ja sakta hai.

Lekin yaad rakhein: yeh Acquittal ya Discharge nahi hoti. Agar mazeed evidence samne aaye to qanooni karwai dobara aage barh sakti hai.

Article 199 ki Writ mein sirf investigation se disagreement ki bunyaad par High Court aam tor par Investigating Officer ki jagah investigation nahi karti. Albatta, clear Mala Fide ya illegal action ho to judicial intervention mumkin ho sakti hai.

Sirf cheque hona recovery ki guarantee nahi hoti. ⚖️

Agar cheque ki bunyaad par recovery ka claim kiya jaye, to court underlying transaction, payment ka proof, witnesses aur cheque ki circumstances ko bhi examine kar sakti hai.

PLD 2026 Lahore 601 mein court ne evidence, withheld witnesses, Article 129(g) Qanun-e-Shahadat, aur photo account se related banking procedure ko consider kiya.

• Bank/payment record preserve karein
• Witnesses ka record rakhein
