Legal Remedies for Non-Development of Project and Non-Payment of Profit/Rental by Developer.
I purchased a residential villa from a reputed developer and entered into an Agreement to Sell / Agreement of Contract with them. Under the terms of the agreement, the developer undertook to complete the project within a specified period and also committed to pay a fixed rental return.
However, the developer has failed to complete the project within the agreed timeframe and has also defaulted in paying the promised rental amount. I have now been informed that the developer is facing certain issues in the project, which has caused significant delays.
In these circumstances, I seek legal advice on the following:
1. What remedies are available to me under the agreement and the applicable laws of Pakistan, including the Contract Act 1872 and the Specific Relief Act 1877?
2. Am I entitled to claim refund of the amount paid along with damages and unpaid rental returns?
3. Can I enforce the agreement and compel the developer to complete the project and hand over possession?
